  1  4 RELATING TO FEES CHARGED FOR SPECIAL FIRE FIGHTER MOTOR
  1  5     VEHICLE REGISTRATION PLATES.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  NEW SECTION.  100B.12  PAUL RYAN MEMORIAL FIRE
  1 10 FIGHTER SAFETY TRAINING FUND.
  1 11    A Paul Ryan memorial fire fighter safety training fund is
  1 12 created in the state treasury under the control of the
  1 13 department of public safety.  The fund shall consist of fees
  1 14 transferred by the treasurer of state from the sale of special
  1 15 fire fighter license plates pursuant to section 321.34,
  1 16 subsection 10.  Moneys in the fund shall be used exclusively
  1 17 by the fire service training bureau to offset fire fighter
  1 18 training costs.  Notwithstanding section 8.33, moneys in the
  1 19 fund shall not revert to the general fund of the state at the
  1 20 end of the fiscal year, but shall remain available for
  1 21 expenditure by the fire service training bureau for fire
  1 22 fighter training in future fiscal years.
  1 23    Sec. 2.  Section 321.34, subsection 10, Code 2003, is
  1 24 amended to read as follows:
  1 25    10.  FIRE FIGHTER PLATES.  The owner of a motor vehicle
  1 26 subject to registration pursuant to section 321.109,
  1 27 subsection 1, light delivery truck, panel delivery truck,
  1 28 pickup, motor home, multipurpose vehicle, motorcycle, trailer,
  1 29 or travel trailer
  1 30    a.  An owner referred to in subsection 12 who is a current
  1 31 or former retired member of a paid or volunteer fire
  1 32 department, may, upon written application to the department,
  1 33 order special registration plates, designed by the department
  1 34 in cooperation with representatives designated by the Iowa
  1 35 fire fighters' associations, which plates signify that the
  2  1 applicant is a current or former retired member of a paid or
  2  2 volunteer fire department.
  2  3    b.  The application shall be approved by the department, in
  2  4 consultation with representatives designated by the Iowa fire
  2  5 fighters' associations, and the special registration plates
  2  6 shall be issued to the applicant in exchange for the
  2  7 registration plates previously issued to the person.  The fee
  2  8 for the special plates shall be is twenty-five dollars which
  2  9 shall be paid in addition to the regular annual registration
  2 10 fee.  The department shall validate the special plates in the
  2 11 same manner as regular registration plates are validated under
  2 12 this section at the regular annual registration fee.
  2 13    c.  The special fees collected by the director under this
  2 14 subsection shall be paid monthly to the treasurer of state and
  2 15 credited to the road use tax fund.  Notwithstanding section
  2 16 423.24, and prior to the crediting of revenues to the road use
  2 17 tax fund under section 423.24, subsection 1, paragraph "b",
  2 18 the treasurer of state shall transfer monthly from those
  2 19 revenues to the Paul Ryan memorial fire fighter safety
  2 20 training fund created pursuant to section 100B.12 the amount
  2 21 of the special fees collected in the previous month for the
  2 22 fire fighter plates.
  2 23    d.  For purposes of this subsection, a person is considered
  2 24 to be retired if the person is recognized by the chief of the
  2 25 fire department where the individual served, and on record, as
  2 26 officially retired from the fire department.  Special
  2 27 registration plates with a fire fighter emblem shall be
  2 28 surrendered, as provided in subsection 12, in exchange for
  2 29 regular registration plates upon termination of the motor
  2 30 vehicle owner's membership in the paid or volunteer fire
  2 31 department, unless the person is a retired member in good
  2 32 standing.
