  1  4 RELATING TO DEER AND ELK CHRONIC WASTING DISEASE BY ESTAB-
  1  5    LISHING A TASK FORCE AND REQUIRING DEPARTMENTAL COOPERATION IN
  1  6    THE IMPLEMENTATION OF A CHRONIC WASTING DISEASE ADMINISTRATIVE
  1  7    STRATEGY, AND PROVIDING AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  CHRONIC WASTING DISEASE – DEFINITIONS.  As
  1 12 used in this Act, unless the context otherwise requires:
  1 13    1.  "Chronic wasting disease" means the animal disease
  1 14 afflicting deer and elk that is a transmissible disease of the
  1 15 nervous system resulting in distinctive lesions in the brain
  1 16 and that belongs to the group of diseases that is known as
  1 17 transmissible spongiform encephalopathies.
  1 18    2.  "Task force" means the chronic wasting disease task
  1 19 force created in section 2 of this Act.
  1 20    Sec. 2.  CHRONIC WASTING DISEASE – TASK FORCE.
  1 21    1.  A chronic wasting disease task force is created to
  1 22 develop a chronic wasting disease administrative strategy as
  1 23 provided in this section.  The members shall be as follows:
  1 24    a.  Three members shall be the following state officials:
  1 25    (1)  The secretary of agriculture, or a designee other than
  1 26 the state veterinarian.
  1 27    (2)  The director of the department of natural resources or
  1 28 a designee.
  1 29    (3)  The state veterinarian.
  1 30    b.  The governor shall appoint four members each
  1 31 representing an interested organization from a list of
  1 32 nominees.  Each of the following interested organizations
  1 33 shall submit nominations:
  1 34    (1)  The Iowa whitetail deer association.
  1 35    (2)  The Iowa elk breeders association.
  2  1    (3)  The Iowa meat processors association.
  2  2    (4)  The Iowa conservation alliance.
  2  3    2.  The task force shall study risks and responses
  2  4 associated with chronic wasting disease in deer and elk
  2  5 populations, including farm deer as defined in section 189A.2.
  2  6 As part of its duties, the task force shall develop
  2  7 recommendations for all of the following:
  2  8    a.  Procedures for the inspection and testing of deer,
  2  9 which may include statistical sampling, laboratory testing,
  2 10 and verification protocols.
  2 11    b.  Methods to respond to reported cases of chronic wasting
  2 12 disease, including the preparation of plans required to
  2 13 contain the spread of the disease.
  2 14    c.  Methods to ensure that owners of farm deer may engage
  2 15 in the movement and sale of farm deer for purposes of breeding
  2 16 or slaughter.
  2 17    d.  Methods to compensate owners of farm deer for
  2 18 depopulation.
  2 19    3.  The task force may consult with the United States
  2 20 department of agriculture and the agencies in neighboring
  2 21 states as required in order to provide for the uniform
  2 22 application of a chronic wasting disease strategy.
  2 23    4.  Members of the task force shall prescribe rules and
  2 24 elect a chairperson.  A member is not entitled to receive
  2 25 reimbursement for actual expenses incurred while engaged in
  2 26 the performance of official duties.  A member is not eligible
  2 27 to receive compensation as provided in section 7E.6.
  2 28    Sec. 3.  CHRONIC WASTING DISEASE – DEPARTMENT OF
  2 29 AGRICULTURE AND LAND STEWARDSHIP AND DEPARTMENT OF NATURAL
  2 30 RESOURCES.
  2 31    1.  The secretary of agriculture, in consultation with the
  2 32 state veterinarian, and the director of the department of
  2 33 natural resources shall act jointly to examine approaches to
  2 34 most effectively implement a chronic wasting disease
  2 35 administrative strategy as provided in section 2 of this Act.
  3  1    2.  The secretary of agriculture and the director of the
  3  2 department of natural resources shall establish definite
  3  3 jurisdictions for their departments and provide mechanisms for
  3  4 cooperation and consultation when implementing the chronic
  3  5 wasting disease administrative strategy.
  3  6    Sec. 4.  CHRONIC WASTING DISEASE – REPORT.
  3  7    1.  The department of agriculture and land stewardship, in
  3  8 cooperation with the department of natural resources, shall
  3  9 submit a report to the governor and general assembly.  The
  3 10 report shall include all of the following:
  3 11    a.  Findings and recommendations by the chronic wasting
  3 12 disease task force, including recommendations for a chronic
  3 13 wasting disease administrative strategy and recommended
  3 14 legislative proposals or proposals for administrative rules
  3 15 required to implement the strategy as provided in section 2 of
  3 16 this Act.
  3 17    b.  Findings and recommendations by the secretary of
  3 18 agriculture, in consultation with the state veterinarian and
  3 19 the director of the department of natural resources, regarding
  3 20 approaches to most effectively implement a chronic wasting
  3 21 disease administrative strategy as provided in section 3 of
  3 22 this Act.  The recommendations shall include any legislative
  3 23 proposals and proposed and adopted administrative rule
  3 24 changes.
  3 25    2.  The report shall be submitted not later than January 1,
  3 26 2004.
  3 27    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  3 28 immediate importance, takes effect upon enactment.
