1 4 RELATING TO SOIL CONSERVATION BY PROVIDING FOR THE ACQUISITION
1 5 OF LAND BY SOIL AND WATER CONSERVATION DISTRICTS, AND ELIMI-
1 6 NATING CERTAIN REPORTING REQUIREMENTS.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 457A.1, Code 2003, is amended to read
1 11 as follows:
1 12 457A.1 ACQUISITION BY OTHER THAN CONDEMNATION.
1 13 The department of natural resources, soil and water
1 14 conservation districts as provided in chapter 161A, the
1 15 historical division of the department of cultural affairs, the
1 16 state archaeologist appointed by the state board of regents
1 17 pursuant to section 263B.1, any county conservation board, and
1 18 any city or agency of a city may acquire by purchase, gift,
1 19 contract, or other voluntary means, but not by eminent domain,
1 20 conservation easements in land to preserve scenic beauty,
1 21 wildlife habitat, riparian lands, wetlands, or forests;
1 22 promote outdoor recreation, agriculture, soil or water
1 23 conservation, or open space; or otherwise conserve for the
1 24 benefit of the public the natural beauty, natural and cultural
1 25 resources, and public recreation facilities of the state.
1 26 Sec. 2. Section 161A.11, Code 2003, is repealed.
