1 1 Section 1. Section 904.108, subsection 6, Code 2003, is
1 2 amended to read as follows:
1 3 6. The director may charge an inmate a correctional fee
1 4 for custodial expenses incurred or which may be incurred while
1 5 the inmate is in the custody of the department. The custodial
1 6 expenses may include, but are not limited to, board and room,
1 7 medical and dental fees including any necessary transportation
1 8 fee not to exceed five dollars per visit, education costs,
1 9 clothing costs, and the costs of supervision, services, and
1 10 treatment to the inmate. The correctional fee shall not
1 11 exceed the actual cost of keeping the inmate in custody. The
1 12 correctional fees collected pursuant to this subsection shall
1 13 be credited as a reimbursement to the appropriate correctional
1 14 institution. This subsection does not limit the right of the
1 15 director to obtain any other remedy authorized by law.
1 16 EXPLANATION
1 17 This bill relates to transporting an inmate for medical or
1 18 dental care, and providing for a fee.
1 19 The bill provides that if the department of corrections
1 20 transports an inmate for medical or dental care, the
1 21 department may charge the inmate a transportation fee not to
1 22 exceed $5 per visit. The bill requires the transportation fee
1 23 to be credited to the correctional institution that provided
1 24 the transportation as reimbursement to that institution.
1 25 Current law provides that any correctional fee under Code
1 26 section 904.108 shall be credited to the correctional
1 27 institution.
