1 1 Section 1. EMPLOYEES OF MEDICAL ASSISTANCE WAIVER SERVICE
1 2 PROVIDERS – TERMINATION.
1 3 1. A provider of services under a medical assistance home
1 4 and community-based services waiver may terminate the contract
1 5 of a person with responsibility for a consumer under the
1 6 waiver to whom payment is being made for provision of services
1 7 under the waiver, if the provider determines that the
1 8 contractor has breached the contract by not providing the
1 9 services agreed to under the contract.
1 10 2. For the purposes of this section, "consumer",
1 11 "provider", and "waiver" mean consumer, provider, and waiver
1 12 as defined in section 249A.29.
1 13 EXPLANATION
1 14 This bill authorizes a provider of services under a medical
1 15 assistance home and community-based services waiver to
1 16 terminate the contract of a person with responsibility for a
1 17 consumer under the wavier to whom payment is being made for
1 18 provision of services under the wavier, if the provider
1 19 determines that the contractor has breached the contract by
1 20 not providing the services agreed to under the contract.
