  1  1    Section 1.  Section 403.5, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4A.  If the urban renewal plan includes a
  1  4 project for housing or residential development, or for
  1  5 providing or aiding in the provision of public improvements
  1  6 related to housing and residential development, the governing
  1  7 body of an affected taxing entity that is a school district or
  1  8 a county, or a school district or a city, whichever is
  1  9 applicable, shall, by resolution, approve the project before
  1 10 the plan may take effect.  For purposes of this subsection, a
  1 11 project does not include the assurance of assistance for low
  1 12 and moderate income family housing required under section
  1 13 403.22.
  1 14    Sec. 2.  Section 403.5, subsection 5, Code 2003, is amended
  1 15 by adding the following new unnumbered paragraph:
  1 16    NEW UNNUMBERED PARAGRAPH.  If the urban renewal plan to be
  1 17 amended or modified includes a project for housing or
  1 18 residential development, or for providing or aiding in the
  1 19 provision of public improvements related to housing and
  1 20 residential development, the governing body of an affected
  1 21 taxing entity that is a school district or a county, or a
  1 22 school district or a city, whichever is applicable, shall, by
  1 23 resolution, approve the project before the amendment or
  1 24 modification to the plan may take effect.  For purposes of
  1 25 this subsection, a project does not include the assurance of
  1 26 assistance for low and moderate income family housing required
  1 27 under section 403.22.
  1 28    Sec. 3.  EFFECTIVE AND APPLICABILITY DATES.  This Act,
  1 29 being deemed of immediate importance, takes effect upon
  1 30 enactment and applies to urban renewal plans proposed on or
  1 31 after the effective date of this Act, and to amendments or
  1 32 modifications proposed to existing urban renewal plans on or
  1 33 after the effective date of this Act.  
  1 34                           EXPLANATION
  1 35    This bill provides that if an urban renewal plan proposed
  2  1 by a city includes a project for housing or residential
  2  2 development, or for providing or aiding in the provision of
  2  3 public improvements related to housing and residential
  2  4 development, the project must be approved by any school
  2  5 district and county that levies property taxes in the urban
  2  6 renewal area before the plan may take effect.  If the urban
  2  7 renewal plan containing a housing or residential development
  2  8 project is proposed by a county, the project must be approved
  2  9 by any school district and city that levies property taxes in
  2 10 the urban renewal area before the plan may take effect.  The
  2 11 bill also applies to amendments or modifications to an
  2 12 existing urban renewal plan if the plan contains a project for
  2 13 housing or residential development.  The bill provides that
  2 14 funds provided as assurance for low and moderate income family
  2 15 housing and residential development under Code section 403.22
  2 16 is not considered a project of the urban renewal plan.
  2 17    The bill takes effect upon enactment and applies to urban
  2 18 renewal plans proposed on or after the effective date of the
  2 19 bill and applies to amendments or modifications to existing
  2 20 urban renewal plans which amendments or modifications are
  2 21 proposed on or after the effective date of the bill.
