  1  1    Section 1.  Section 455B.183A, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  A water quality protection fund is created in the state
  1  4 treasury under the control of the department.  The fund
  1  5 consists of moneys appropriated to the fund by the general
  1  6 assembly, moneys deposited into the fund from fees described
  1  7 in subsection 2, moneys deposited into the fund from fees
  1  8 collected pursuant to sections 455B.187 and 455B.190A, and
  1  9 other moneys available to and obtained or accepted by the
  1 10 department from the United States government or private
  1 11 sources for placement in the fund.  The fund is divided into
  1 12 two three accounts, including the administration account, and
  1 13 the public water supply system account, and the private water
  1 14 supply system account.  Moneys in the administration account
  1 15 shall be used are appropriated to the department for purposes
  1 16 of carrying out the provisions of this division, which relate
  1 17 to the administration, regulation, and enforcement of the
  1 18 federal Safe Drinking Water Act.  Moneys in the public water
  1 19 supply system account shall be used are appropriated to the
  1 20 department to support the program to assist supply systems, as
  1 21 provided in section 455B.183B.  Moneys in the private water
  1 22 supply system account are appropriated to the department for
  1 23 the purpose of supporting the programs established to protect
  1 24 private drinking water supplies as provided in sections
  1 25 455B.187, 455B.188, 455B.190, and 455B.190A.
  1 26    Sec. 2.  Section 455B.187, Code 2003, is amended by adding
  1 27 the following new unnumbered paragraph after unnumbered
  1 28 paragraph 2:
  1 29    NEW UNNUMBERED PARAGRAPH.  The director may charge a fee
  1 30 for permits issued pursuant to this section.  All fees
  1 31 collected pursuant to this section shall be deposited into the
  1 32 private water supply system account within the water quality
  1 33 protection fund created in section 455B.183A.
  1 34    Sec. 3.  Section 455B.190A, subsection 5, Code 2003, is
  1 35 amended by adding the following new paragraph:
  2  1    NEW PARAGRAPH.  c.  All fees collected pursuant to this
  2  2 subsection shall be deposited into the private water supply
  2  3 system account within the water quality protection fund
  2  4 created in section 455B.183A.  
  2  5                           EXPLANATION
  2  6    This bill provides that the director of the department of
  2  7 natural resources may collect permit fees from private water
  2  8 supply well contractors pursuant to Code section 455B.187, and
  2  9 that fees collected pursuant to Code sections 455B.187 and
  2 10 455B.190A shall be deposited into a new account called the
  2 11 private water supply system account established within the
  2 12 water quality protection fund already created in the state
  2 13 treasury.  The bill also appropriates the moneys deposited in
  2 14 the private water supply system account to the department for
  2 15 the purpose of supporting programs established to protect
  2 16 private drinking water supplies as provided in Code sections
  2 17 455B.187, 455B.188, 455B.190, and 455B.190A.
