  1  1    Section 1.  Section 403.5, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  A municipality shall not approve an urban renewal
  1  4 project for an urban renewal area unless the governing body
  1  5 has, by resolution, determined the area to be a slum area,
  1  6 blighted area, economic development area or a combination of
  1  7 those areas, and designated the area as appropriate for an
  1  8 urban renewal project.  The local governing body shall not
  1  9 approve an urban renewal plan until a general plan for the
  1 10 municipality has been prepared.  For this purpose and other
  1 11 municipal purposes, authority is vested in every municipality
  1 12 to prepare, to adopt and to revise from time to time, a
  1 13 general plan for the physical development of the municipality
  1 14 as a whole, giving due regard to the environs and metropolitan
  1 15 surroundings.  A municipality shall not acquire real property
  1 16 for an urban renewal project unless the local governing body
  1 17 has approved the urban renewal project in accordance with
  1 18 subsection 4.  Notwithstanding any provisions in this chapter
  1 19 to the contrary, a municipality shall not approve an urban
  1 20 renewal project for retail development and a municipality
  1 21 shall not approve an urban renewal plan that contains separate
  1 22 urban renewal projects for retail development.  For purposes
  1 23 of this subsection, "retail development" means construction or
  1 24 reconstruction of a building or structure which is used or
  1 25 intended to be used by any person, firm, partnership,
  1 26 association, or corporation who operates, maintains, or
  1 27 conducts, either in person, or by any agent or employee, any
  1 28 place of business from which any goods or services are sold or
  1 29 offered for sale, at retail, for consumption or use, and
  1 30 includes ancillary buildings or structures, such as parking
  1 31 facilities and storage buildings.
  1 32    2.  EFFECTIVE DATE.  This Act, being deemed of immediate
  1 33 importance, takes effect upon enactment.  
  1 34                           EXPLANATION
  1 35    This bill prohibits a municipality from approving an urban
  2  1 renewal project for retail development.  The bill also
  2  2 prohibits a municipality from approving an urban renewal plan
  2  3 if it contains separate urban renewal projects for retail
  2  4 development.  The bill defines "retail development".
  2  5    The bill takes effect upon enactment.
