PAG LIN 1 1 Section 1. STUDENT ACHIEVEMENT AND TEACHER QUALITY 1 2 PROGRAM. There is appropriated from the general fund of the 1 3 state to the department of education for the fiscal year 1 4 beginning July 1, 2003, and ending June 30, 2004, the 1 5 following amount, or so much thereof as is necessary, to be 1 6 used for the purposes designated: 1 7 For purposes of the student achievement and teacher quality 1 8 program established pursuant to chapter 284: 1 9 .................................................. $111,591,336 1 10 Sec. 2. Section 256.18, subsection 2, unnumbered paragraph 1 11 2, Code 2003, is amended by striking the unnumbered paragraph. 1 12 Sec. 3. Section 256.21, unnumbered paragraph 4, Code 2003, 1 13 is amended to read as follows: 1 14 A sabbatical grant to a teacher shall be equal to the costs 1 15 to the school district of the teacher's regular compensation 1 16as defined in section 294A.2plus the cost to the district of 1 17 the fringe benefits of the teacher. The grant shall be paid 1 18 to the school district, and the district shall continue to pay 1 19 the teacher's regular compensation as well as the cost to the 1 20 district of the substitute teacher. Teachers and boards of 1 21 school districts are encouraged to seek funding from other 1 22 sources to pay the costs of sabbaticals for teachers. Grant 1 23 moneys are miscellaneous income for purposes of chapter 257. 1 24 Sec. 4. Section 256.39, subsection 8, Code 2003, is 1 25 amended by striking the subsection. 1 26 Sec. 5. Section 256A.4, subsection 1, unnumbered paragraph 1 27 1, Code 2003, is amended to read as follows: 1 28 The board of directors of each school district may develop 1 29 and offer a program which provides outreach and incentives for 1 30 the voluntary participation of expectant parents and parents 1 31 of children in the period of life from birth through age five, 1 32 who reside within district boundaries, in educational family 1 33 support experiences designed to assist parents in learning 1 34 about the physical, mental, and emotional development of their 1 35 children.A district providing a family support program,2 1which seeks additional funding under sections 294A.13 through2 2294A.16, shall meet the requirements of this section and the2 3program shall be subject to approval by the department of2 4education.A board may contract with another school district 2 5 or public or private nonprofit agency for provision of the 2 6 approved program or program site. 2 7 Sec. 6. Section 258.17, subsection 4, Code 2003, is 2 8 amended to read as follows: 2 9 4. Each workstart program shall include a written 2 10 agreement by the school or school district with one or more 2 11 businesses from the surrounding community to provide 2 12 workplace-specific training and learning programs which are 2 13 related to the skills needed to succeed in those occupational 2 14 areas. The proposed plan for implementation of the workstart 2 15 program shall include a copy of the written agreement between 2 16 the school or school district and the business or businesses 2 17 and a business support component, which shall consist of 2 18 financial or in-kind support, or both financial and in-kind 2 19 support, from the businesses that have entered into the 2 20 agreement with the school or school district.The plan may2 21provide for the utilization of phase III and other available2 22school funds in the establishment of the program. A workstart2 23program is a comprehensive school transformation program under2 24section 294A.14.2 25 Sec. 7. Section 282.18, subsection 7, Code 2003, is 2 26 amended to read as follows: 2 27 7. A pupil participating in open enrollment shall be 2 28 counted, for state school foundation aid purposes, in the 2 29 pupil's district of residence. A pupil's residence, for 2 30 purposes of this section, means a residence under section 2 31 282.1. The board of directors of the district of residence 2 32 shall pay to the receiving district the state cost per pupil 2 33 for the previous school year, plus any moneys received for the 2 34 pupil as a result of the non-English speaking weighting under 2 35 section 280.4, subsection 3, for the previous school year 3 1 multiplied by the state cost per pupil for the previous year. 3 2The district of residence shall also transmit the phase III3 3moneys allocated to the district for the previous year for the3 4full-time equivalent attendance of the pupil, who is the3 5subject of the request, to the receiving district specified in3 6the request for transfer.If the pupil participating in open 3 7 enrollment is also an eligible pupil under chapter 261C, the 3 8 receiving district shall pay the tuition reimbursement amount 3 9 to an eligible postsecondary institution as provided in 3 10 section 261C.6. 3 11 Sec. 8. Section 284.13, subsection 1, Code 2003, is 3 12 amended by adding the following new paragraphs: 3 13 NEW PARAGRAPH. i. For the fiscal year beginning July 1, 3 14 2003, and each succeeding fiscal year, the amount of one 3 15 hundred thousand dollars to the department of education for 3 16 distribution to the tribal council of the Sac and Fox Indian 3 17 settlement located on land held in trust by the secretary of 3 18 the interior of the United States. Moneys allocated under 3 19 this paragraph shall be used for the purposes specified in 3 20 section 256.30. 3 21 NEW PARAGRAPH. j. For the fiscal year beginning July 1, 3 22 2003, and each succeeding fiscal year, the amount of one 3 23 hundred seventy thousand dollars to the state board of regents 3 24 for distribution in the amount of sixty-eight thousand dollars 3 25 to the Iowa braille and sight saving school and in the amount 3 26 of one hundred two thousand dollars to the Iowa state school 3 27 for the deaf. 3 28 NEW PARAGRAPH. k. For the fiscal year beginning July 1, 3 29 2003, and each succeeding fiscal year, the amount of ninety- 3 30 four thousand six hundred dollars to be paid to the state 3 31 board of regents for distribution to licensed classroom 3 32 teachers at the Iowa braille and sight saving school and the 3 33 Iowa school for the deaf for payments of minimum salary 3 34 supplements based upon the average yearly enrollment at each 3 35 school as determined by the state board of regents. 4 1 NEW PARAGRAPH. l. For the fiscal year beginning July 1, 4 2 2003, and each succeeding fiscal year, the amount of one 4 3 hundred fifteen thousand five hundred dollars to be paid to 4 4 the department of human services for distribution to its 4 5 licensed classroom teachers at institutions under the control 4 6 of the department of human services for minimum salary 4 7 supplements based upon the average student yearly enrollment 4 8 at each institution as determined by the department of human 4 9 services. 4 10 Sec. 9. Section 331.909, subsection 2, Code 2003, is 4 11 amended to read as follows: 4 12 2. The activities of a multidisciplinary community 4 13 services team shall not duplicate the activities of a 4 14 multidisciplinary team for child abuse under section 235A.13, 4 15 dependent adult abuse activities under section 235B.6,area4 16education agency activities under section 294A.14,or child 4 17 victim services provided under section 915.35. 4 18 Sec. 10. Chapter 294A, Code 2003, is repealed. 4 19 EXPLANATION 4 20 This bill repeals Code chapter 294A, which creates the 4 21 educational excellence program and includes a standing 4 22 appropriation for the program. The bill also appropriates 4 23 moneys to the department of education from the state general 4 24 fund for purposes of the student achievement and teacher 4 25 quality program, funding from that program some of the 4 26 purposes and entities currently provided for by Code chapter 4 27 294A. 4 28 The educational excellence program consists of three 4 29 phases: Phase I establishes a minimum annual salary and a 4 30 formula for distribution of state moneys to assist school 4 31 districts in meeting the minimum salary requirement; phase II 4 32 provides state aid for general salary increases; and phase III 4 33 moneys are distributed to assist in the development of 4 34 performance-based pay plans and supplemental pay plans 4 35 requiring additional instructional work assignments. Phase II 5 1 and III moneys have also been used to fund salary increases 5 2 for licensed classroom teachers at department of human 5 3 services institutions, the Iowa braille and sight saving 5 4 school, the Iowa school for the deaf, and the Sac and Fox 5 5 Indian settlement; participation in the national assessment of 5 6 education progress; the ambassador to education position; a K- 5 7 12 management information system; professional development at 5 8 the Iowa braille and sight saving school and the Iowa state 5 9 school for the deaf; and the Iowa mathematics and science 5 10 coalition. 5 11 The bill also strikes from the Code any references to Code 5 12 chapter 294A, including language that permits the use of phase 5 13 III moneys for purposes of character education programs, the 5 14 career pathways program, family support programs, and 5 15 workstart programs. The bill also strikes language requiring 5 16 a pupil's district of residence to transmit phase III moneys 5 17 it received for a pupil participating in open enrollment to 5 18 the receiving district. 5 19 The bill appropriates nearly $111.6 million for FY 2003- 5 20 2004 for purposes of the student achievement and teacher 5 21 quality program, which includes funding for the teacher career 5 22 path and the beginning teacher mentoring and induction 5 23 program, and, under the bill, includes salary increases for 5 24 licensed classroom teachers at department of human services 5 25 institutions, the Iowa braille and sight saving school, the 5 26 Iowa school for the deaf, and the Sac and Fox Indian 5 27 settlement; and professional development at the Iowa braille 5 28 and sight saving school and the Iowa state school for the 5 29 deaf. 5 30 LSB 1892YH 80 5 31 kh/cf/24
