1 1 Section 1. Section 232.68, subsection 2, Code 2003, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. aa. The commission of a child endangerment
1 4 offense described in section 726.6, subsection 1, with or to a
1 5 child as a result of the acts or omissions of the person
1 6 responsible for the care of the child. Notwithstanding
1 7 section 702.5, the commission of an offense under this
1 8 paragraph includes any offense referred to in section 726.6,
1 9 subsection 1, with or to a person under the age of eighteen
1 10 years.
1 11 EXPLANATION
1 12 This bill includes child endangerment offenses described in
1 13 Code section 726.6 in the definition of child abuse used under
1 14 the juvenile justice code in Code section 232.68.
1 15 The child abuse definition in Code section 232.68 is used
1 16 for reporting of child abuse to the department of human
1 17 services, for performing assessments of child abuse reports,
1 18 and for making determinations as to whether child abuse was
1 19 committed.
1 20 Child endangerment offenses under Code section 726.6
1 21 include acting in a manner that creates a substantial risk to
1 22 a child or minor's physical, mental, or emotional health or
1 23 safety; causing bodily injury or intending to cause serious
1 24 injury; causing substantial mental or emotional harm;
1 25 withholding necessary food, clothing, shelter, health care, or
1 26 supervision; permitting the continuing physical or sexual
1 27 abuse of a child or minor; and abandonment.
1 28 Under the criminal code in Code section 702.5, a child is
1 29 defined as a person under age 14; however, the bill provides
1 30 that child abuse occurs with any child endangerment offense
1 31 described in Code section 726.6 committed with or to a person
1 32 under age 18.
