1 1 Section 1. Section 135C.2, subsection 3, paragraph a, Code
1 2 2003, is amended by adding the following new subparagraph:
1 3 NEW SUBPARAGRAPH. (3) Within the residential care
1 4 facility category, a special license classification for
1 5 residential facilities intended to serve persons who are
1 6 elders as defined in section 231A.1 and which contain five or
1 7 fewer residents. A facility within the special classification
1 8 established pursuant to this subparagraph is exempt from the
1 9 requirements of section 135.63.
1 10 EXPLANATION
1 11 This bill requires the department of inspections and
1 12 appeals to establish within the residential care facility
1 13 category of health care facilities, a special license
1 14 classification for residential facilities intended to serve
1 15 persons who are elders and which contain five or fewer
1 16 residents. A facility within the special classification is
1 17 exempt from certificate of need requirements.
