1 2 #1. Page 20, by inserting after line 27, the
1 3 following:
1 4 "Sec. . Section 8D.13, subsection 12, Code
1 5 Supplement 2003, is amended to read as follows:
1 6 12. The commission, on its own or as recommended
1 7 by an advisory committee of the commission and
1 8 approved by the commission, shall permit a fee to be
1 9 charged by a receiving site to the originator of the
1 10 communication provided on the network. The fee
1 11 charged shall be for the purpose of recovering the
1 12 operating costs of a receiving site. The fee charged
1 13 shall be reduced by an amount received by the
1 14 receiving site pursuant to a state appropriation for
1 15 such costs, or federal assistance received for such
1 16 costs. Fees established under this subsection shall
1 17 be paid by the originator of the communication
1 18 directly to the receiving site. In the event that an
1 19 entity requests a receiving site location in a video
1 20 classroom facility which is authorized by, but not
1 21 funded by, the originator of the communication, the
1 22 requesting entity shall be directly billed by the
1 23 video classroom facility for operating costs relating
1 24 to the communication. For purposes of this section,
1 25 "operating costs" include the costs associated with
1 26 the management or coordination, operations, utilities,
1 27 classroom, equipment, maintenance, and other costs
1 28 directly related to providing the receiving site."
