1 3 #1. Page 166, by inserting after line 19 the
1 4 following:
1 5 "The division of criminal investigation and bureau
1 6 of identification shall conduct a pilot project to
1 7 evaluate the use of brain fingerprinting as a pretrial
1 8 investigative technique, including, but not limited
1 9 to, the effectiveness of brain fingerprinting as a
1 10 method of reducing investigatory costs by assisting in
1 11 determining whether a defendant has knowledge of
1 12 specific information regarding a crime and the
1 13 effectiveness of brain fingerprinting as a method of
1 14 reducing trial costs by assisting the county attorney
1 15 or the defendant in determining the validity of the
1 16 criminal offense charged. The pilot project shall be
1 17 conducted pursuant to a contract with an Iowa business
1 18 that has experience using brain fingerprinting
1 19 technology in actual criminal cases. The contract
1 20 shall contain a provision under which the business
1 21 agrees to forgo reimbursement of its expenses
1 22 regarding the pilot project up to $108,000, unless the
1 23 division determines that, as a result of conducting
1 24 the pilot project, the state of Iowa realizes a
1 25 savings of at least $108,000. The division, in
1 26 consultation with the contracting business, shall file
1 27 a report regarding the results of the pilot project
1 28 with the cochairpersons and ranking members of the
1 29 joint appropriations subcommittee on the justice
1 30 system and the legislative services agency by January
1 31 15, 2005."
