  1  1    Amend House File 2391 as follows:
  1  2    #1.  Page 4, by striking lines 17 through 32 and
  1  3 inserting the following:
  1  4    "3.  A caretaker who intentionally commits
  1  5 dependent adult abuse on a dependent adult in
  1  6 violation of this section is guilty of a class "C"
  1  7 felony if the intentional dependent adult abuse
  1  8 results in serious injury.
  1  9    4.  A caretaker who recklessly commits dependent
  1 10 adult abuse on a dependent adult in violation of this
  1 11 section is guilty of a class "D" felony if the
  1 12 reckless dependent adult abuse results in serious
  1 13 injury.
  1 14    5.  A caretaker who intentionally commits dependent
  1 15 adult abuse on a dependent adult in violation of this
  1 16 section is guilty of a class "C" felony if the
  1 17 intentional dependent adult abuse results in physical
  1 18 injury.
  1 19    6.  A caretaker who commits dependent adult abuse
  1 20 by exploiting a dependent adult in violation of this
  1 21 section is guilty of a class "D" felony if the value
  1 22 of the property, assets, or resources exceeds one
  1 23 hundred dollars.
  1 24    7.  A caretaker who recklessly commits dependent
  1 25 adult abuse on a person in violation of this section
  1 26 is guilty of an aggravated misdemeanor if the reckless
  1 27 dependent adult abuse results in physical injury.
  1 28    8.  A caretaker who commits dependent adult abuse
  1 29 by exploiting a dependent adult in violation of this
  1 30 section is guilty of a simple misdemeanor if the value
  1 31 of the property, assets, or resources is one hundred
  1 32 dollars or less."
