1 2 #1. Page 20, by inserting after line 26, the
1 3 following:
1 4 "Sec. . Section 99F.7, subsection 10,
1 5 paragraphs a and c, Code 2003, are amended to read as
1 6 follows:
1 7 a. A license to conduct gambling games on an
1 8 excursion gambling boat in a county shall be issued
1 9 only if the county electorate approves the conduct of
1 10 the gambling games as provided in this subsection.
1 11 The board of supervisors, upon receipt of a valid
1 12 petition meeting the requirements of section 331.306,
1 13 shall direct the commissioner of elections to submit
1 14 to the registered voters of the county a proposition
1 15 to approve or disapprove the conduct of gambling games
1 16 on an excursion gambling boat in the county. The
1 17 proposition shall be submitted at a general election
1 18 or at a special election called for that purpose. To
1 19 be submitted at a general election, the petition must
1 20 be received by the board of supervisors at least five
1 21 working days before the last day for candidates for
1 22 county offices to file nomination papers for the
1 23 general election pursuant to section 44.4. A bond in
1 24 an amount fixed and with sureties approved by the
1 25 auditor and conditioned upon the payment of all costs
1 26 and expenses incurred in the election shall be filed
1 27 with the petition. In case it is necessary to incur
1 28 any expense in excess of the amount of the bond, the
1 29 board of supervisors shall require the filing of an
1 30 additional bond by the petitioners, and an election
1 31 shall not be held until the additional bond is filed
1 32 in a sufficient amount to cover such expense. If a
1 33 majority of the county voters voting on the
1 34 proposition favor the conduct of gambling games, the
1 35 commission may issue one or more licenses as provided
1 36 in this chapter, only after the first licensee has
1 37 reimbursed the petitioners the actual costs of the
1 38 election. If a majority of the county voters voting
1 39 on the proposition do not favor the conduct of
1 40 gambling games, a license to conduct gambling games in
1 41 the county shall not be issued.
1 42 c. If a licensee of a pari-mutuel racetrack who
1 43 held a valid license issued under chapter 99D as of
1 44 January 1, 1994, requests in writing a license to
1 45 operate gambling games as provided in this chapter,
1 46 the board of supervisors of a county in which the
1 47 licensee of a pari-mutuel racetrack requests a license
1 48 to operate gambling games shall submit to the county
1 49 electorate a proposition to approve or disapprove the
1 50 operation of gambling games at pari-mutuel racetracks
2 1 at a special election at the earliest practicable
2 2 time. A bond in an amount fixed and with sureties
2 3 approved by the auditor and conditioned upon the
2 4 payment of all costs and expenses incurred in the
2 5 election shall be filed with the written request. In
2 6 case it is necessary to incur any expense in excess of
2 7 the amount of the bond, the board of supervisors shall
2 8 require the filing of an additional bond by the pari-
2 9 mutual licensee, and an election shall not be held
2 10 until the additional bond is filed in a sufficient
2 11 amount to cover such expense. If the operation of
2 12 gambling games at the pari-mutuel racetrack is not
2 13 approved by a majority of the county electorate voting
2 14 on the proposition at the election, the commission
2 15 shall not issue a license to operate gambling games at
2 16 the racetrack."
