1 1 Amend House File 2134 as follows:
1 2 #1. Page 1, by striking lines 17 through 19, and
1 3 inserting the following: "community-based services,
1 4 other than nursing care, as defined by this chapter
1 5 and departmental rule, are provided. For the purposes
1 6 of this definition, the home and community-based
1 7 services to be provided are limited to the type
1 8 included under the medical assistance program provided
1 9 pursuant to chapter 249A, are subject to cost
1 10 limitations established by the department of human
1 11 services under the medical assistance program, and
1 12 except as otherwise provided by the department of
1 13 inspections and appeals with the concurrence of the
1 14 department of human services are limited in capacity
1 15 to the number of residents admitted to a residential
1 16 care facility on or before December 1, 2003."
1 17 #2. By striking page 1, line 34, through page 2,
1 18 line 1, and inserting the following: "than nursing
1 19 care, as defined by this chapter and departmental
1 20 rule, are provided. For the purposes of this section,
1 21 the home and community-based services to be provided
1 22 shall be limited to the type included under the
1 23 medical assistance program provided pursuant to
1 24 chapter 249A, shall be subject to cost limitations
1 25 established by the department of human services under
1 26 the medical assistance program, and except as
1 27 otherwise provided by the department of inspections
1 28 and appeals with the concurrence of the department of
1 29 human services shall be limited in capacity to the
1 30 number of residents admitted to a residential care
1 31 facility on or before December 1, 2003."
