  1  1    Amend House File 697 as follows:
  1  2    #1.  Page 12, by inserting after line 20 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  453A.38A  TOBACCO PRODUCT
  1  5 AND CIGARETTE SAMPLES – RESTRICTIONS –
  1  6 ADMINISTRATION.
  1  7    1.  A manufacturer, distributor, wholesaler,
  1  8 retailer, or distributing agent or agent thereof shall
  1  9 not give away cigarettes or tobacco products at any
  1 10 time in connection with the manufacturer's,
  1 11 distributor's, wholesaler's, retailer's, or
  1 12 distributing agent's business or for promotion of the
  1 13 business or cigarettes or tobacco products, except as
  1 14 provided in subsection 2.
  1 15    2.  All cigarette or little cigar samples shall be
  1 16 shipped to a distributor that has a permit to stamp
  1 17 cigarettes or little cigars with Iowa tax.  The
  1 18 manufacturer shipping samples regulated under this
  1 19 section shall send an affidavit to the director
  1 20 stating the quantity and to whom the samples were
  1 21 shipped.  The distributor receiving the shipment shall
  1 22 send an affidavit to the director stating the quantity
  1 23 and from whom the samples were shipped.  These
  1 24 affidavits shall be duly notarized and submitted to
  1 25 the director at time of shipment and receipt of the
  1 26 samples.  The distributor shall pay the tax on samples
  1 27 by separate remittance along with the affidavit."
