PAG LIN 1 1 Amend House File 683 as follows: 1 2 #1. Page 5, by inserting after line 18 the 1 3 following: 1 4 "Sec. . NEW SECTION. 15G.221 LOCAL MATCHING 1 5 MONEYS SPECIAL ELECTIONS. 1 6 1. a. A board of supervisors or city council 1 7 required to expend local matching moneys in return for 1 8 receiving moneys originating from the Iowa values fund 1 9 shall cause a notice of the proposed expenditure, 1 10 including a statement of the amount and purpose for 1 11 the expenditure, and the right to petition for an 1 12 election, to be published as provided in subsection 2 1 13 at least ten days prior to the meeting at which it is 1 14 proposed to take action for the approval of the 1 15 expenditure. 1 16 b. If at any time before the date fixed for taking 1 17 action to approve the expenditure of local matching 1 18 moneys, a petition is filed with the county 1 19 commissioner of elections in the manner provided by 1 20 subsection 3 asking that the question of expending 1 21 local matching moneys be submitted to the registered 1 22 voters of the county or city, the board of supervisors 1 23 or the city council shall either by resolution declare 1 24 the proposal to expend local matching moneys to have 1 25 been abandoned or shall direct the county commissioner 1 26 of elections to call a special election upon the 1 27 question of the expenditure of local matching moneys. 1 28 Notice of the election and its conduct shall be in the 1 29 manner provided in subsections 4 and 5. 1 30 c. If no petition is filed, or if a petition is 1 31 filed and the proposition of expending local matching 1 32 moneys is approved at an election, the board of 1 33 supervisors or the city council may proceed with the 1 34 approval of the expenditure of local matching moneys. 1 35 2. Unless otherwise provided by state law, when 1 36 notice is required by this section, the board of 1 37 supervisors or the city council shall publish the 1 38 notice at least once in one or more newspapers which 1 39 meet the requirements of section 618.14. 1 40 3. a. If a petition of the voters is authorized 1 41 by this section, the petition is valid if signed by 1 42 eligible electors of the county or city, as 1 43 applicable, equal in number to at least ten percent of 1 44 the votes cast in the county or city, as applicable, 1 45 for the office of president of the United States or 1 46 governor at the preceding general election, unless 1 47 otherwise provided by state law. The petition shall 1 48 include the signatures of the petitioners, a statement 1 49 of their place of residence, and the date on which 1 50 they signed the petition. 2 1 b. A petition shall be examined before it is 2 2 accepted for filing. If it appears valid on its face 2 3 it shall be accepted for filing. If it lacks the 2 4 required number of signatures it shall be returned to 2 5 the petitioners. 2 6 c. Petitions which have been accepted for filing 2 7 are valid unless written objections are filed. 2 8 Objections must be filed with the county commissioner 2 9 of elections within five working days after the 2 10 petition was filed. The objection process in section 2 11 44.7 shall be followed for objections filed pursuant 2 12 to this section. 2 13 4. At the election the proposition shall be 2 14 submitted in the following form: 2 15 Shall the county (or city) of 2 16 ........................, state of Iowa, be authorized 2 17 to expend not more than $......... of local matching 2 18 moneys for ..................... (state purpose of 2 19 project)? 2 20 5. Notice of the election shall be given by 2 21 publication as specified in subsection 2. At the 2 22 election, the ballot used for the submission of the 2 23 proposition shall be in substantially the form for 2 24 submitting special questions at general elections. 2 25 For a proposition to be carried or adopted, a majority 2 26 of the total votes cast for and against the 2 27 proposition at the election is required. If the 2 28 proposition is approved by the voters, the board of 2 29 supervisors or the city council may proceed with the 2 30 approval of the expenditure of local matching moneys." 2 31 #2.
