  1  1    Amend Senate File 390, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking page 2, line 12 through page 3,
  1  4 line 7, and inserting the following:
  1  5    "Sec.    .  Section 331.234, subsection 4, Code
  1  6 2003, is amended to read as follows:
  1  7    4.  The Except as otherwise provided in subsection
  1  8 5, the expenses of the commission may be paid from the
  1  9 general fund of the county or.  Expenses of the
  1 10 commission may also be paid from any combination of
  1 11 public or private funds available for that purpose.
  1 12 The commission's annual expenses may exceed the amount
  1 13 in subsection 3 only if the excess is paid from
  1 14 private funds.  If a proposed charter is submitted to
  1 15 the electorate, private funds donated to the
  1 16 commission may be used to promote passage of the
  1 17 proposed charter.
  1 18    Sec.    .  Section 331.234, Code 2003, is amended
  1 19 by adding the following new subsection:
  1 20    NEW SUBSECTION.  5.  In the case of a city-county
  1 21 consolidation charter commission or a community
  1 22 commonwealth charter commission, the expenses of the
  1 23 commission shall be paid by each city and county
  1 24 participating in the charter process pursuant to
  1 25 section 331.233A.  Each participating city's share
  1 26 shall be its pro rata share of the expenses based upon
  1 27 the ratio that the population of the city bears to the
  1 28 total population in the county.  The remainder shall
  1 29 be paid from the general fund of the county.  The
  1 30 amount paid by each city and county participating in
  1 31 the charter process shall be deposited in a segregated
  1 32 account maintained by the county."
