  1  1    Amend House File 391 as follows:
  1  2    #1.  Page 2, line 19, by inserting after the word
  1  3 "applicable." the following:  "The guidelines, rules,
  1  4 and procedures shall not require participation in a
  1  5 cogeneration pilot project or program by any rate-
  1  6 regulated public utility providing retail electric
  1  7 service to more than five hundred twenty thousand
  1  8 customers in the state as of January 1, 2003, but any
  1  9 such utility shall have the option to participate."
  1 10    #2.  Page 3, line 10, by striking the word
  1 11 "facility" and inserting the following:  "facility,
  1 12 alternate energy production facility, cogeneration
  1 13 pilot project facility,".
  1 14    #3.  Page 4, by striking lines 27 through 29 and
  1 15 inserting the following:  "public utility shall have
  1 16 the option of proceeding with construction or lease of
  1 17 the facility in Iowa or withdrawing according to
  1 18 either of the following:
  1 19    (1)  Withdrawing its application for a ratemaking
  1 20 principles determination pursuant to this section and
  1 21 its application for a certificate under pursuant to
  1 22 chapter 476A.
  1 23    (2)  Proceeding with the construction or lease of
  1 24 the facility or implementation of an energy sales
  1 25 agreement related to a cogeneration pilot project
  1 26 facility."
  1 27    #4.  Page 5, line 26, by striking the words
  1 28 "months, and" and inserting the following:  "months
  1 29 or".
  1 30    #5.  By renumbering, relettering, redesignating,
  1 31 and correcting internal references as necessary.
