  1  1    Section 1.  NEW SECTION.  514C.21  MORATORIUM ON MANDATED
  1  2 HEALTH OR MEDICAL EXPENSE COVERAGES.
  1  3    A policy or contract providing for third-party payment or
  1  4 prepayment of health or medical expenses shall not be required
  1  5 to include coverage for specific health or medical expense
  1  6 benefits other than those required under the Code of Iowa 2001
  1  7 or Code Supplement 2001, or pursuant to other provision of law
  1  8 in effect on June 30, 2002.
  1  9    Sec. 2.  INSURANCE DIVISION STUDY ON MANDATED COVERAGES.
  1 10    1.  The insurance division of the department of commerce
  1 11 shall conduct a study to determine the impact of the
  1 12 following:
  1 13    a.  Mandating coverage for specific benefits.
  1 14    b.  Imposition of a moratorium on new mandated coverages.
  1 15    2.  The division shall include in the study all of the
  1 16 following:
  1 17    a.  An estimate of the impact of all current mandated
  1 18 coverage requirements on insurance costs.
  1 19    b.  An estimate of the impact of imposing a moratorium on
  1 20 new mandated coverages on insurance costs.
  1 21    c.  Actions taken by the division to ensure that third-
  1 22 party payors are in compliance with mandated benefit
  1 23 requirements.
  1 24    d.  The extent to which, if any, mandating coverage
  1 25 requirements results in any person not being covered by
  1 26 insurance who otherwise would have been covered.
  1 27    e.  An analysis and comparison of the choices for treatment
  1 28 with regard to mandated benefit coverages and the level of
  1 29 access, choice, and financial burden on the individual.
  1 30    f.  Identification of any segments of the population of
  1 31 this state that may be excluded from, or have limited access
  1 32 to treatment that is subject to mandated coverage
  1 33 requirements, including the number of citizens that may be
  1 34 excluded from, or have limited access to treatment under
  1 35 third-party payor policies or contracts provided by employers
  2  1 that receive substantial revenue from public sources.
  2  2    3.  The insurance division shall submit a written report to
  2  3 the general assembly on or before January 15, 2003.  
  2  4                           EXPLANATION 
  2  5    This bill creates new Code section 514C.21, which imposes a
  2  6 moratorium on new mandated health or medical expenses
  2  7 coverages.
  2  8    The bill also requires the insurance division to perform a
  2  9 study on both current mandates and the moratorium, and their
  2 10 effect on insurance costs and treatment availability.  The
  2 11 report is due to the general assembly on or before January 15,
  2 12 2003.
