PAG LIN 1 1 Section 1. Section 97A.6, subsection 5, paragraph c, Code 1 2 2001, is amended to read as follows: 1 3 c. Disease under this sectionshall meanmeans heart 1 4 disease or any disease of the lungs or respiratory tractand1 5shall be presumed to have been. A rebuttable presumption 1 6 arises that the disease was contracted while on active duty as 1 7 a result of strain, exposure, or the inhalation of noxious 1 8 fumes, poison, or gases. However, if a person's membership in 1 9 the system first commenced on or after July 1, 1992, and the 1 10 heart disease or disease of the lungs or respiratory tract 1 11 would not exist, but for a medical condition that was known to 1 12 exist on the date that membership commenced, the presumption 1 13 established in this paragraph shall not apply. 1 14 Sec. 2. Section 97B.50A, subsection 2, paragraph c, Code 1 15 2001, is amended to read as follows: 1 16 c. Disease under this subsectionshall meanmeans heart 1 17 disease or any disease of the lungs or respiratory tractand1 18shall be presumed to have been. A rebuttable presumption 1 19 arises that the disease was contracted while on active duty as 1 20 a result of strain, exposure, or the inhalation of noxious 1 21 fumes, poison, or gases. However, if a person's special 1 22 service membership in the system first commenced on or after 1 23 July 1, 2000, and the heart disease or disease of the lungs or 1 24 respiratory tract would not exist, but for a medical condition 1 25 that was known to exist on the date that special service 1 26 membership commenced, the presumption established in this 1 27 paragraph shall not apply. 1 28 Sec. 3. Section 411.6, subsection 5, paragraph c, Code 1 29 2001, is amended to read as follows: 1 30 c. Disease under this sectionshall meanmeans heart 1 31 disease or any disease of the lungs or respiratory tractand1 32shall be presumed to have been. A rebuttable presumption 1 33 arises that the disease was contracted while on active duty as 1 34 a result of strain or the inhalation of noxious fumes, poison 1 35 or gases. However, if a person's membership in the system 2 1 first commenced on or after July 1, 1992, and the heart 2 2 disease or disease of the lungs or respiratory tract would not 2 3 exist, but for a medical condition that was known to exist on 2 4 the date that membership commenced, the presumption 2 5 established in this paragraph shall not apply. 2 6 Sec. 4. EFFECTIVE DATE. This Act, being deemed of 2 7 immediate importance, takes effect upon enactment. 2 8 EXPLANATION 2 9 This bill concerns the establishment of an entitlement to 2 10 an accidental disability retirement benefit for members 2 11 covered under the peace officers' retirement system and the 2 12 municipal police and fire retirement system, and for certain 2 13 special service members covered under the Iowa public 2 14 employees' retirement system. 2 15 Under current law, heart disease or disease of the lungs or 2 16 respiratory tract is presumed to be work-related, entitling 2 17 the person to an accidental disability retirement benefit. 2 18 The bill provides that the presumption created is rebuttable. 2 19 The bill takes effect upon enactment. 2 20 LSB 6144XC 79 2 21 ec/sh/8
