PAG LIN 1 1 Section 1. Section 724.10, Code 2001, is amended to read 1 2 as follows: 1 3 724.10 APPLICATION FOR PERMIT TO CARRY WEAPONS CRIMINAL 1 4 HISTORY CHECK REQUIRED. 1 5 A person shall not be issued a permit to carry weapons 1 6 unless the person has completed and signed an application on a 1 7 form to be prescribed and published by the commissioner of 1 8 public safety. The application shall state the full name, 1 9social security number (optional)driver's license or 1 10 nonoperator's identification card number, residence, and age 1 11 of the applicant, and shall state whether the applicant has 1 12 ever been convicted of a felony, whether the person is 1 13 addicted to the use of alcohol or any controlled substance, 1 14 and whether the person has any history of mental illness or 1 15 repeated acts of violence. The applicant shall also display 1 16 an identification card that bears a distinguishing number 1 17 assigned to the card holder, the full name, date of birth, 1 18 sex, residence address, and a brief description and colored 1 19 photograph of the card holder.Upon notification that1 20criminal history data is available but not later than July 1,1 211991, theThe sheriff shall conduct immediately a criminal 1 22 history check concerning each applicant by obtaining criminal 1 23 history data from the department of public safety. A person 1 24 who knowingly makes a false statement of material fact on the 1 25 application commits a class "D" felony. 1 26 Sec. 2. Section 724.17, Code 2001, is amended to read as 1 27 follows: 1 28 724.17 APPLICATION FOR ANNUAL PERMIT TO ACQUIRE 1 29 CRIMINAL HISTORY CHECK REQUIRED. 1 30 The application for an annual permit to acquire pistols or 1 31 revolvers may be made to the sheriff of the county of the 1 32 applicant's residence and shall be on a form prescribed and 1 33 published by the commissioner of public safety. The 1 34 application shall state the full name of the applicant, the 1 35social securitydriver's license or nonoperator's 2 1 identification card number of the applicant, the residence of 2 2 the applicant, and the age of the applicant. The applicant 2 3 shall also display an identification card that bears a 2 4 distinguishing number assigned to the cardholder, the full 2 5 name, date of birth, sex, residence address, and brief 2 6 description and colored photograph of the cardholder, or other 2 7 identification as specified by rule of the department of 2 8 public safety.Upon notification that criminal history data2 9is available but not later than July 1, 1991, theThe sheriff 2 10 shall conduct a criminal history check concerning each 2 11 applicant by obtaining criminal history data from the 2 12 department of public safety. Section 724.19, Code 2001, is amended to read as 2 16 follows: 2 17 724.19 ISSUANCE OF ANNUAL PERMIT TO ACQUIRE. 2 18 The annual permit to acquire pistols or revolvers shall be 2 19 issued to the applicant immediately upon completion of the 2 20 application unless the applicant is disqualified under the 2 21 provisions of section 724.15 and shall be on a form prescribed 2 22 and published by the commissioner of public safety. The 2 23 permit shall contain the name of the permittee,the social2 24security number of the permittee,the residence of the 2 25 permittee, and the effective date of the permit. 2 26 Sec. 4. Section 724.24, Code 2001, is amended to read as 2 27 follows: 2 28 724.24 PURCHASE OR SALE OF FIREARMS INCONTIGUOUS STATESA 2 29 STATE OTHER THAN IOWA. 2 30 A resident of Iowa not otherwise precluded by applicable 2 31 law,may purchase rifles, shotguns, ammunition, reloading 2 32 components, or firearms accessories from a dealer licensed in 2 33states contiguous toa state other than Iowa. This 2 34 authorization is enacted in conformance withthe gun control2 35Act of 1968,18 U.S.C., section} 922(b)(3)(A).In the event3 1that presently enacted federal restrictions on the purchase of3 2firearms, rifles, shotguns, ammunition, reloading components,3 3or firearms accessories are repealed or set aside by courts of3 4competent jurisdiction, this section shall in no way be3 5interpreted to prohibit or restrict the purchase of firearms,3 6shotguns, rifles, ammunition, reloading components, or3 7firearms accessories by residents of Iowa otherwise competent3 8to purchase the same in contiguous or other states.3 9 A dealer licensed in Iowa may sell or deliver a rifle or 3 10 shotgun, and a collector licensed in Iowa may sell or deliver 3 11 a rifle or shotgun if it is a curio or relic, to a resident of 3 12an adjacentany state, if the purchaser's state of residence 3 13 permits such sale or delivery by law, the sale fully complies 3 14 with the legal conditions of Iowa and theadjacentpurchaser's 3 15 state of residence, and the purchaser and licensee have, prior 3 16 to the sale or delivery for sale of the rifle or shotgun, 3 17 complied with all the requirements ofthe federal gun control3 18Act of 196818 U.S.C. } 922(b)(3)(A). 3 19 A resident of Iowa shall not receive or transport a firearm 3 20 from a resident of another state who is not a licensed dealer 3 21 unless the resident of Iowa acquires the firearm by bequest or 3 22 intestate succession and the resident of Iowa is permitted to 3 23 receive and transport the firearm under applicable law. 3 24 EXPLANATION 3 25 This bill relates to permits for and the authority to 3 26 acquire weapons. 3 27 The bill eliminates the requirement that an applicant for a 3 28 weapons permit or for an annual permit to acquire pistols or 3 29 revolvers provide a social security number on the application 3 30 and requires instead that an applicant provide either a 3 31 driver's license or nonoperator's identification card number. 3 32 The bill also provides that a person who knowingly makes a 3 33 false statement of material fact on an application for an 3 34 annual permit to acquire a pistol or revolver commits a class 3 35 "D" felony. A class "D" felony is punishable by confinement 4 1 for no more than five years and a fine of at least $750 but 4 2 not more than $7,500. 4 3 The bill allows a resident of Iowa to purchase rifles, 4 4 shotguns, and other firearm accessories from a dealer licensed 4 5 in a state other than Iowa. The bill also allows an Iowa 4 6 licensed dealer and an Iowa licensed curio or relic collector 4 7 to sell or deliver a rifle or shotgun to a purchaser in any 4 8 state that permits such a sale and the sale complies with the 4 9 legal conditions of Iowa and the purchaser's state. 4 10 The bill further provides that a resident of Iowa shall not 4 11 receive or transport firearms from a resident of another state 4 12 who is not a federally licensed firearm dealer unless the 4 13 resident of Iowa acquires by bequest or intestate succession 4 14 and the resident of Iowa is permitted to receive or transport 4 15 firearms under applicable law. 4 16 LSB 5063DP 79 4 17 rh/sh/8.1
