There is appropriated from the healthy Iowans 1 3 tobacco trust created in section 12.65 to the following 1 4 departments for the fiscal year beginning July 1, 2001, and 1 5 ending June 30, 2002, the following amounts, or so much 1 6 thereof as is necessary, to be used for the purposes 1 7 designated: 1 8 1. To the department of human services: 1 9 a. To maintain the reimbursement rate for all 1 10 noninstitutional medical assistance providers, with the 1 11 exception of anesthesia and dental services, at the rate 1 12 provided under the federal Medicare program for such providers 1 13 during the fiscal year beginning July 1, 2000, and ending June 1 14 30, 2001, as specified in 2000 Iowa Acts, chapter 1221, 1 15 section 1, subsection 1, paragraph "a", for the fiscal year 1 16 July 1, 2001, through June 30, 2002, and to continue the 1 17 resource-based relative value system of reimbursement under 1 18 the medical assistance program: 1 19 .................................................. $ 11,595,718 1 20 b. To the Iowa department of public health: 3 17 a. For the tobacco use prevention and control initiative, 3 18 including efforts at the state and local levels, as provided 3 19 in chapter 142A: 3 20 .................................................. $ 9,345,394 3 21 (1) The director of public health shall dedicate 3 22 sufficient resources to promote and ensure retailer compliance 3 23 with tobacco laws and ordinances relating to persons under 18 3 24 years of age, and shall prioritize the state's compliance in 3 25 the allocation of available funds to comply with 42 U.S.C. 3 26 300X-26. 3 27 (2) Of the full-time equivalent positions funded under 3 28 this section, two full-time equivalent positions shall be 3 29 utilized to provide for enforcement of tobacco laws, 3 30 regulations, and ordinances under a chapter 28D agreement 3 31 entered into between the Iowa department of public health and 3 32 the alcoholic beverages division of the department of 3 33 commerce. 3 34 (3) Of the funds appropriated in this paragraph "a", not 3 35 more than $525,759 shall be expended on administration and 4 1 management of the program. 4 2 b. For additional substance abuse treatment under the 4 3 substance abuse treatment program: 4 4 .................................................. $ 11,900,000 4 5 (1) The department shall use funds appropriated in this 4 6 paragraph "b" to enhance the quality of and to expand the 4 7 capacity to provide 24-hour substance abuse treatment 4 8 programs. 4 9 (2) The department shall use funds appropriated in this 4 10 paragraph to expand the length of individual client substance 4 11 abuse treatment plans, as necessary to reduce program 4 12 recidivism. 4 13 (3) The department shall use funds appropriated in this 4 14 paragraph to share research-based best practices for treatment 4 15 with substance abuse treatment facilities. 4 16 (4) The department shall use funds appropriated in this 4 17 paragraph to develop a results-based funding approach for 4 18 substance abuse treatment services. 4 19 (5) The department shall use funds appropriated in this 4 20 paragraph to develop a program to encourage individuals who 4 21 are successfully managing their substance abuse problems to 4 22 serve as role models. 4 23 c. For the healthy Iowans 2010 plan within the Iowa 4 24 department of public health: 4 25 .................................................. $ 2,550,000 4 26 (1) Of the funds appropriated in this paragraph "c", not 4 27 more than $1,250,000 shall be used for core public health 4 28 functions, including home health care and public health 4 29 nursing services, contracted through a formula by local boards 4 30 of health, to enhance disease and injury prevention services. 4 31 (2) Of the funds appropriated in this paragraph "c", not 4 32 more than $400,000 shall be used for the continuation and 4 33 support of a coordinated system of delivery of trauma and 4 34 emergency medical services. 4 35 (3) Of the funds appropriated in this paragraph "c", not 5 1 more than $437,000 shall be used for the state poison control 5 2 center. 5 3 (4) Of the funds appropriated in this paragraph "c", not 5 4 more than $300,000 shall be used for the development of 5 5 scientific and medical expertise in environmental 5 6 epidemiology. 5 7 (5) Of the funds appropriated in this paragraph "c", not 5 8 more than $81,500 shall be used to implement prevention 5 9 strategies of healthy Iowans 2010 to address the leading 5 10 causes of death in Iowa. 5 11 (6) Of the funds appropriated in this paragraph "c", not 5 12 more than $81,500 shall be used for the childhood lead 5 13 poisoning prevention program. 5 14 6. To the department of corrections: 5 15 .................................................. $ 610,000 5 16 a. Of the fund appropriated in this subsection, $127,217 5 17 is allocated to the second judicial district department of 5 18 correctional services to replace expired federal funding for 5 19 day programming. 5 20 b. Of the funds appropriated in this subsection $35,359 is 5 21 allocated to the third judicial district department of 5 22 correctional services to replace expired federal funding for 5 23 the drug court program. 5 24 c. Of the funds appropriated in this subsection, $191,731 5 25 is allocated to the fourth judicial district department of 5 26 correctional services for a drug court program. 5 27 d. Of the funds appropriated in this subsection, $255,692 5 28 is allocated to the fifth judicial district department of 5 29 correctional services to replace expired funding for the drug 5 30 court program. 5 31 Sec. 2. PURCHASE OF SERVICE CONTRACT PROVIDERS 5 32 REIMBURSEMENT INCREASE. There is appropriated from the 5 33 healthy Iowans tobacco trust created in section 12.65 to the 5 34 property tax relief fund created in section 426B.1 for the 5 35 fiscal year beginning July 1, 2001, and ending June 30, 2002, 6 1 the following amount, or so much thereof as is necessary, to 6 2 be used for the purposes designated: 6 3 For assistance to the counties with limited county mental 6 4 health, mental retardation, and developmental disabilities 6 5 services fund balances which were selected in accordance with 6 6 2000 Iowa Acts, chapter 1221, section 3 to receive such 6 7 assistance in the same amount provided during the fiscal year 6 8 beginning July 1, 2000, and ending June 30, 2001, to pay 6 9 reimbursement increases in accordance with 2000 Iowa Acts, 6 10 chapter 1221, section 3: 6 11 .................................................. $ 146,750 6 12 Sec. 3. SAVINGS ACCOUNT FOR HEALTHY IOWANS 6 13 APPROPRIATIONS. There is appropriated from the savings 6 14 account for healthy Iowans created within the tobacco 6 15 settlement endowment fund created in section 12.65, Code 2001, 6 16 to the following funds and entities for the fiscal year 6 17 beginning July 1, 2001, and ending June 30, 2002, the 6 18 following amounts, or so much thereof as is necessary, to be 6 19 used for the purposes designated: 6 20 1. To the Iowa empowerment fund created in section 28.9 6 21 for deposit in the school ready children grants account and 6 22 for distribution as provided in this subsection: 6 23 .................................................. $ 1,153,250 6 24 The moneys appropriated in this subsection shall be used 6 25 along with other appropriations made to the Iowa empowerment 6 26 fund and shall be distributed for the fiscal year beginning 6 27 July 1, 2001, in the same proportion that the annualized grant 6 28 amount for each designated community empowerment area in the 6 29 previous fiscal year bears to the adjusted total amount 6 30 distributed for school ready children grants in the previous 6 31 fiscal year. The adjusted total amount distributed shall be 6 32 calculated by reflecting an annualized grant amount for each 6 33 community empowerment area that received a grant in that 6 34 fiscal year. 6 35 2. To the Iowa department of public health to be used for 7 1 the purpose designated and for not more than the following 7 2 full-time equivalent positions: 7 3 For establishing and operating the substance abuse 7 4 treatment facility for persons on probation as created in 7 5 section 135.130 and providing staffing for the facility to be 7 6 used exclusively to provide substance abuse treatment for 7 7 persons on probation and under the supervision of the judicial 7 8 district department of correctional services: 7 9 .................................................. $ 2,000,000 7 10 ............................................... FTEs 60.00 7 11 3. Any moneys remaining in the savings account for healthy 7 12 Iowans created within the tobacco settlement endowment fund 7 13 created in section 12.65, Code 2001, on June 30, 2001, shall 7 14 be transferred to the healthy Iowans tobacco trust created in 7 15 section 12.65, as amended in this Act, to be used for the 7 16 purposes specified in that section. 7 17 Sec. 4. PRIOR YEAR NONREVERSION. Notwithstanding 2000 7 18 Iowa Acts, chapter 1221, section 5, moneys appropriated under 7 19 2000 Iowa Acts, chapter 1221, section 3, for purchase of 7 20 service contract providers which is unexpended or unencumbered 7 21 at the end of the fiscal year beginning July 1, 2000, and 7 22 ending June 30, 2001, shall be deposited in the healthy Iowans 7 23 tobacco trust created in section 12.65, as amended in this 7 24 Act, to be used for the purposes specified in that section. 7 25 Sec. 5. Section 12.65, Code 2001, is amended to read as 7 26 follows: 7 27 12.65 HEALTHY IOWANS TOBACCOSETTLEMENT ENDOWMENT FUND7 28 TRUST. 7 29 1. A healthy Iowans tobaccosettlement endowment fund7 30 trust is created in the office of the treasurer of state. 7 31After payment of litigation costs, all moneys paid to the7 32state pursuant to the master settlement agreement, as defined7 33in section 453C.1,Moneys appropriated to the healthy Iowans 7 34 tobacco trust from the endowment for Iowa's health account of 7 35 the tobacco settlement trust fund established in section 8 1 12E.12 and from any other source shall be deposited in the 8 2fundhealthy Iowans tobacco trust. 8 32. Any moneys paid to the state by the tobacco settlement8 4authority pursuant to chapter 12E shall be deposited in the8 5fund. Additionally, the state's share of the moneys which are8 6not sold to the tobacco settlement authority pursuant to8 7chapter 12E shall be deposited in the fund.8 83.2. Moneys deposited in thefundhealthy Iowans tobacco 8 9 trust shall be used only in accordance with appropriations 8 10 from thefundhealthy Iowans tobacco trust for purposes 8 11 related to health care, substance abuse treatment and 8 12 enforcement, tobacco use prevention and control, and other 8 13 purposes related to the needs of children, adults, and 8 14 families in the state. 8 154. A savings account for healthy Iowans is created within8 16the tobacco settlement endowment fund. Moneys, appropriated8 17annually, shall be deposited in the account and shall be8 18invested to provide an ongoing source of investment earnings.8 195.3. Notwithstanding section 8.33, any unexpended balance 8 20 in thefundhealthy Iowans tobacco trust at the end of the 8 21 fiscal year shall be retained in thefundtrust. 8 22 Notwithstanding section 12C.7, subsection 2, interest or 8 23 earnings on investments or time deposits of the moneys in the 8 24 healthy Iowans tobaccosettlement endowment fund, in the8 25savings account for healthy Iowans, and in any other account8 26established within the fundtrust shall be credited to the 8 27 healthy Iowans tobaccosettlement endowment fund, to the8 28savings account for healthy Iowans, or to any other account8 29established, respectivelytrust. 8 306. For the purposes of this section, "litigation costs"8 31are those costs itemized by the attorney general and submitted8 32to and approved by the attorney general.8 337.4. Moneys in thefundhealthy Iowans tobacco trust 8 34 shall be considered part of the general fund of the state for 8 35 cash flow purposes only, provided any moneys used for cash 9 1 flow purposes are returned to thefundtrust by the close of 9 2 each fiscal year. 9 3 Sec. 6. Section 135.11, Code 2001, is amended by adding 9 4 the following new subsection: 9 5 NEW SUBSECTION. 26. Establish and administer a substance 9 6 abuse treatment facility pursuant to section 135.130. 9 7 DIVISION XIII 9 8 Sec. 7. NEW SECTION. 135.130 SUBSTANCE ABUSE TREATMENT 9 9 FACILITY FOR PERSONS ON PROBATION. 9 10 1. The director shall establish and operate a facility for 9 11 the purpose of providing a structured treatment program for 9 12 persons with a substance abuse problem who are on probation 9 13 and under the supervision of a judicial district department of 9 14 correctional services. The department shall enter into an 9 15 agreement pursuant to chapter 28E with the department of 9 16 corrections for assistance in establishing security for the 9 17 facility. The department, in consultation with the department 9 18 of corrections, shall adopt rules pursuant to chapter 17A to 9 19 administer this section. The rules adopted shall include 9 20 rules related to the treatment requirements of the program. 9 21 2. A substance abuse treatment facility advisory council 9 22 is established within the department to advise and make 9 23 recommendations to the director regarding the establishment 9 24 and operation of a facility for persons with a substance abuse 9 25 problem who are on probation and to assist with the 9 26 implementation of treatment programs that are proven to be 9 27 effective for offenders. The substance abuse treatment 9 28 facility advisory council shall consist of the directors of 9 29 the eight judicial district departments of correctional 9 30 services and one representative each from the judicial branch, 9 31 the Iowa department of public health, the department of 9 32 corrections, and the governor's office of drug control policy. 9 33 3. The department, in consultation with the department of 9 34 corrections and the advisory council, shall adopt rules 9 35 pursuant to chapter 17A to establish and operate the facility. 10 1 Sec. 8. Section 136.3, subsection 7, Code 2001, is amended 10 2 to read as follows: 10 3 7. Adopt, promulgate, amend, and repeal rules and 10 4 regulations consistent with law for the protection of the 10 5 public health and prevention of substance abuse, and for the 10 6 guidance of the department. All rules which have been or are 10 7 hereafter adopted by the department shall be subject to 10 8 approval by the board. However, rules adopted by the 10 9 commission on substance abuse for section 125.7, subsections 1 10 10 and 7, and rules adopted by the department pursuant to section 10 11 135.130 are not subject to approval by the board of health. 10 12 Sec. 9. Section 249A.3, subsection 2, Code 2001, is 10 13 amended by adding the following new paragraph after paragraph 10 14 a, and renumbering the subsequent paragraph: 10 15 NEW PARAGRAPH. aa. As provided under the federal Breast 10 16 and Cervical Cancer Prevention and Treatment Act of 2000, Pub. 10 17 L. No. 106-354, women who meet all of the following criteria: 10 18 (1) Are not described in 42 U.S.C. } 1396a(a)(10)(A)(i). 10 19 (2) Have not attained age sixty-five. 10 20 (3) Have been screened for breast and cervical cancer 10 21 under the United States centers for disease control and 10 22 prevention breast and cervical cancer early detection program 10 23 established under 42 U.S.C. } 300k et seq., in accordance with 10 24 the requirements of 42 U.S.C. } 300n, and need treatment for 10 25 breast or cervical cancer. A woman is considered screened for 10 26 breast and cervical cancer under this subparagraph if the 10 27 woman is screened by any provider or entity, and the state 10 28 grantee of the United States centers for disease control and 10 29 prevention funds under Title XV of the federal Public Health 10 30 Services Act has elected to include screening activities by 10 31 that provider or entity as screening activities pursuant to 10 32 Title XV of the federal Public Health Services Act. This 10 33 screening includes breast or cervical cancer screenings or 10 34 diagnostic services provided by family planning or community 10 35 health centers. 11 1 (4) Are not otherwise covered under creditable coverage as 11 2 defined in 42 U.S.C. } 300gg(c). 11 3 A woman who meets the criteria of this paragraph shall be 11 4 presumptively eligible for medical assistance. 11 5 Sec. 10. Section 901B.1, subsection 1, paragraph c, Code 11 6 2001, is amended by adding the following new subparagraph: 11 7 NEW SUBPARAGRAPH. (5) A substance abuse treatment 11 8 facility as established and operated by the Iowa department of 11 9 public health. 11 10 Sec. 11. Section 901B.1, subsection 4, paragraph a, Code 11 11 2001, is amended to read as follows: 11 12 a. The district department of correctional services shall 11 13 place an individual committed to it under section 907.3 to the 11 14 sanction and level of supervision which is appropriate to the 11 15 individual based upon a current risk assessment evaluation. 11 16 Placements may be to levels two and three of the corrections 11 17 continuum. The district department may, with the approval of 11 18 the Iowa department of public health and the department of 11 19 corrections, place an individual in a level three substance 11 20 abuse treatment facility established pursuant to section 11 21 135.130, to assist the individual in complying with a 11 22 condition of probation. The district department may, with the 11 23 approval of the department of corrections, place an individual 11 24 in a level four violator facility established pursuant to 11 25 section 904.207 only as a penalty for a violation of a 11 26 condition imposed under this section. 11 27 Sec. 12. REVERSION. Any moneys appropriated under this 11 28 Act that are unexpended or unencumbered at the end of the 11 29 fiscal year beginning July 1, 2001, and ending June 30, 2002, 11 30 shall revert to the healthy Iowans tobacco trust. 11 31 Sec. 13. REFERENCES. References in this Act to the 11 32 tobacco settlement endowment fund and to the savings account 11 33 for healthy Iowans of the tobacco settlement endowment fund 11 34 are references to the fund and the account pursuant to section 11 35 12.65, Code 2001, and, unless otherwise provided, 12 1 appropriations from the fund and the account are references to 12 2 appropriations of moneys in the fund and the account on or 12 3 before June 30, 2001, and such moneys shall remain available 12 4 for appropriation for the fiscal year beginning July 1, 2001, 12 5 and ending June 30, 2002, as provided in this Act. 12 6 Sec. 14. EFFECTIVE DATE. Section 4 of this Act, relating 12 7 to nonreversion of funds remaining unencumbered or unobligated 12 8 which were appropriated for the purchase of service contract 12 9 providers, being deemed of immediate importance, takes effect 12 10 upon enactment. 12 11 Sec. 15. CONTINGENT EFFECTIVE DATE. The section in this 12 12 Act amending section 12.65 shall take effect only if 2001 Iowa 12 13 Acts, Senate File 532 is enacted. If 2001 Iowa Acts, Senate 12 14 File 532 is not enacted, the section in this Act amending 12 15 section 12.65 shall not take effect and references in this Act 12 16 to the healthy Iowans tobacco trust are references to the 12 17 tobacco settlement endowment fund created in section 12.65, 12 18 Code 2001. If 2001 Iowa Acts, Senate File 532 is not enacted, 12 19 all moneys paid to the state pursuant to the master settlement 12 20 agreement as defined in section 453C.1 shall be deposited in 12 21 the tobacco settlement endowment fund created in section 12 22 12.65, Code 2001. 12 23 EXPLANATION 12 24 This bill relates to and makes appropriations from the 12 25 tobacco settlement endowment fund. 12 26 The bill makes the following appropriations to the 12 27 department of human services: 12 28 1. To maintain the reimbursement rate for all 12 29 noninstitutional providers at the rate paid under the federal 12 30 Medicare program during FY 2000-2001, and for continuation of 12 31 the resource-based relative value system, for the fiscal year 12 32 beginning July 1, 2001, and ending June 30, 2002: 12 33 $11,595,718. 12 34 2. To maintain the reimbursement rate for dental services 12 35 at the usual and customary rate as provided during FY 2000- 13 1 2001 for the fiscal year beginning July 1, 2001, and ending 13 2 June 30, 2002: $3,814,973. 13 3 3. To maintain the cost-of-living adjustment for 13 4 rehabilitative treatment services providers as provided during 13 5 FY 2000-2001, for the fiscal year beginning July 1, 2001, and 13 6 ending June 30, 2002: $3,243,026. 13 7 4. To maintain the cost-of-living adjustment for adoption, 13 8 independent living, shelter care, and home studies services 13 9 providers as provided during FY 2000-2001, for the fiscal year 13 10 beginning July 1, 2001, and ending June 30, 2002: $468,967. 13 11 5. To maintain the reimbursement rate for hospitals as 13 12 provided during FY 2000-2001, for the fiscal year beginning 13 13 July 1, 2001, and ending June 30, 2002: $3,035,278. 13 14 6. To maintain the reimbursement rate for home health 13 15 agencies at the rate provided to such agencies as provided 13 16 during FY 2000-2001, for the fiscal year beginning July 1, 13 17 2001, and ending June 30, 2002: $2,108,279. 13 18 7. To maintain the reimbursement rate for critical access 13 19 hospitals at the rate provided such hospitals under the 13 20 federal Medicare program during FY 2000-2001, for the fiscal 13 21 year beginning July 1, 2001, and ending June 30, 2002: 13 22 $250,000. 13 23 8. To maintain the expansion of home health care services 13 24 and habilitative day care services under the medical 13 25 assistance program for children with special needs: 13 26 $1,975,496. 13 27 9. To maintain the expansion of respite care services 13 28 provided through home and community-based waiver services 13 29 under the medical assistance program: $1,137,309. 13 30 10. To maintain the reimbursement rate as provided during 13 31 FY 2000-2001 for service providers under the purview of the 13 32 department of human services: $545,630. 13 33 The bill provides $200,000 for supplementation of the 13 34 appropriation for the children's health insurance program. 13 35 The bill provides $4,000,000 for supplementation of the 14 1 medical assistance appropriation. 14 2 The bill appropriates $250,000 to the department of human 14 3 services to provide coverage under the medical assistance 14 4 program to certain women who require treatment for breast or 14 5 cervical cancer. The bill also codifies language to include 14 6 this optional category of coverage under the medical 14 7 assistance program. 14 8 The bill appropriates $9,345,394 to the Iowa department of 14 9 public health for the tobacco use prevention and control 14 10 program and $11,900,000 for additional substance abuse 14 11 treatment. Under this appropriation, the department is 14 12 directed to enhance the quality of and to expand capacity to 14 13 provide 24-hour substance abuse treatment programs for 14 14 children; to expand the length of individual client substance 14 15 abuse treatment plans, as necessary to reduce recidivism; to 14 16 share research-based best practices for treatment with 14 17 substance abuse treatment facilities; to develop a results- 14 18 based funding approach for substance abuse treatment services; 14 19 and to develop a program to encourage individuals who are 14 20 successfully managing their substance abuse problems to serve 14 21 as role models. 14 22 The bill appropriates $2,550,000 to the Iowa department of 14 23 public health for development of a healthy Iowans 2010 plan 14 24 including the use of up to the following amounts for the 14 25 following purposes: $1,250,000 for core public health 14 26 functions including home health care and public health nursing 14 27 services contracted through a formula by local boards of 14 28 health, to enhance disease and injury prevention services; 14 29 $400,000 for the implementation and support of a coordinated 14 30 system of delivery of trauma and emergency medical services; 14 31 $437,000 for the poison control center; $300,000 for 14 32 development of scientific and medical expertise in 14 33 environmental epidemiology; $81,500 for prevention strategies 14 34 to address the leading causes of deaths of Iowans; and $81,500 14 35 for the childhood lead poisoning prevention program. 15 1 The bill appropriates $610,000 to the department of 15 2 corrections for day programming and the drug court program. 15 3 The bill appropriates $146,750 to the property tax relief 15 4 fund for the fiscal year beginning July 1, 2001, and ending 15 5 June 30, 2002, for assistance to counties with limited county 15 6 mental health, mental retardation, and developmental 15 7 disabilities services fund balances to pay reimbursement 15 8 increases in the same amount as provided in the fiscal year 15 9 beginning July 1, 2000, and ending June 30, 2001. 15 10 The bill appropriates $1,153,250 from the savings account 15 11 for healthy Iowans created within the tobacco settlement 15 12 endowment fund created in section 12.65, Code 2001, to the 15 13 Iowa empowerment fund for the fiscal year beginning July 1, 15 14 2001, and ending June 30, 2002, for deposit in the school 15 15 ready children grants account and provides for distributing 15 16 the moneys. 15 17 The bill appropriates $2,000,000 from the savings account 15 18 for healthy Iowans created within the tobacco settlement 15 19 endowment fund created in section 12.65, Code 2001, to the 15 20 Iowa department of public health for the fiscal year beginning 15 21 July 1, 2001, and ending June 30, 2002, for establishing and 15 22 operating a substance abuse treatment facility and providing 15 23 staffing for the facility to be used to provide substance 15 24 abuse treatment for persons on probation and under the 15 25 supervision of a judicial district department of correctional 15 26 services. 15 27 The bill provides that any moneys remaining at the end of 15 28 the fiscal year from the appropriation for the fiscal year 15 29 beginning July 1, 2000, and ending June 30, 2001, for 15 30 assistance to counties with limited county mental health, 15 31 mental retardation, and developmental disabilities services 15 32 fund balances to pay reimbursement increases, is to not 15 33 revert, but is to be deposited in the healthy Iowans tobacco 15 34 trust to be used for the purposes of the trust. 15 35 The bill also amends Code section 12.65, the tobacco 16 1 settlement endowment fund, to rename the fund the healthy 16 2 Iowans tobacco trust. The bill also provides that moneys 16 3 appropriated from the healthy Iowans tobacco trust from the 16 4 endowment for Iowa's health account of the tobacco settlement 16 5 trust fund established in Code section 12E.12 and from any 16 6 other source are to be deposited in the healthy Iowans tobacco 16 7 trust. The bill eliminates the savings account for healthy 16 8 Iowans that was established within the tobacco settlement 16 9 endowment fund. 16 10 The bill provides that the department of public health 16 11 shall establish a substance abuse treatment facility to 16 12 provide a structured substance abuse treatment program for 16 13 persons who are on probation and under the supervision of a 16 14 judicial district department of correctional services. The 16 15 bill provides that the department of public health and the 16 16 department of corrections shall enter into a Code chapter 28E 16 17 agreement to assist the department in establishing security 16 18 for the facility. The bill provides that a judicial district 16 19 may, with the approval of the department of public health and 16 20 the department of corrections, place a person who is on 16 21 probation at the substance abuse treatment facility to assist 16 22 the person in complying with the terms and conditions of 16 23 probation. 16 24 The bill establishes a substance abuse treatment facility 16 25 advisory council within the Iowa department of public health 16 26 to advise and make recommendations to the director of public 16 27 health. The members of the council shall consist of the 16 28 directors of the eight judicial district departments of 16 29 correctional services, and representatives of the judicial 16 30 branch, the Iowa department of public health, the department 16 31 of corrections, and the governor's office of drug control 16 32 policy. 16 33 The bill provides that moneys appropriated in the bill that 16 34 are unexpended or unencumbered at the end of the fiscal year 16 35 beginning July 1, 2001, and ending June 30, 2002, are to 17 1 revert to the healthy Iowans tobacco trust. 17 2 The bill provides that references in the bill to the 17 3 tobacco settlement endowment fund and to the savings account 17 4 for healthy Iowans are to the fund and the account as created 17 5 in section 12.65, Code 2001, and that unless otherwise 17 6 provided, appropriations from the fund and the account are 17 7 from moneys in the fund and the account on or before June 30, 17 8 2001, and such moneys are to remain available for 17 9 appropriation in the fiscal year beginning July 1, 2001, and 17 10 ending June 30, 2002, as provided in the bill. 17 11 The bill provides that the section of the bill relating to 17 12 nonreversion of moneys appropriated for purchase of service 17 13 contract providers takes effect upon enactment. 17 14 The bill provides that the section in the bill amending 17 15 section 12.65 takes effect only if 2001 Iowa Acts, Senate File 17 16 532 takes effect and that if 2001 Iowa Acts, Senate File 532 17 17 is not enacted, the section in the bill amending section 12.65 17 18 does not take effect and the references to the healthy Iowans 17 19 tobacco trust are references to the tobacco settlement 17 20 endowment fund created in section 12.65, Code 2001. If 2001 17 21 Iowa Acts, Senate File 532 is not enacted, all moneys paid to 17 22 the state under the master settlement agreement are to be 17 23 deposited in the tobacco settlement endowment fund created in 17 24 section 12.65, Code 2001. 17 25 LSB 1155SC 79 17 26 pf/cls/14.6
