  1  2       BY  (PROPOSED COMMITTEE ON RULES AND ADMINISTRATION
  1  3               RESOLUTION BY CHAIRPERSON IVERSON)
  1  4 A Concurrent Resolution requesting that the Attorney
  1  5    General of the State of Iowa vigorously enforce Iowa
  1  6    corporate farming law which prohibits processors from
  1  7    owning, controlling, or operating a feedlot in Iowa
  1  8    in which hogs or cattle are fed for slaughter.
  1  9    WHEREAS, under Iowa Code section 9H.2 of Iowa's corporate
  1 10 farming law, it is unlawful for any processor of beef or pork
  1 11 to own, control, or operate a feedlot in Iowa in which hogs or
  1 12 cattle are fed for slaughter; and
  1 13    WHEREAS, processors are attempting to circumvent the legal
  1 14 prohibitions provided in Iowa Code section 9H.2 by using
  1 15 various direct and indirect schemes to control feedlots,
  1 16 including by providing financing to or executing production
  1 17 contracts with persons who own or operate feedlots in Iowa;
  1 18 and
  1 19    WHEREAS, Smithfield Foods, Inc. has financed the
  1 20 acquisition by Stoecker Farms, Inc. of the Iowa operations of
  1 21 Murphy Family Farms; and
  1 22    WHEREAS, it is the sense of the Iowa General Assembly that
  1 23 the use by processors of various direct and indirect schemes
  1 24 to control feedlots in Iowa in which hogs or cattle are fed
  1 25 for slaughter constitutes the impermissible control of a
  1 26 feedlot in violation of Iowa Code section 9H.2; and
  1 27    WHEREAS, the Attorney General of the State of Iowa is
  1 28 responsible for the enforcement of Iowa's corporate farming
  1 29 law, including Iowa Code section 9H.2, by instituting suits on
  1 30 behalf of the state to prevent and restrain violations of that
  1 31 section and to seek civil penalties as provided in Iowa Code
  1 32 section 9H.3; NOW THEREFORE,
  1 33    BE IT RESOLVED BY THE SENATE, THE HOUSE OF REPRESENTATIVES
  1 34 CONCURRING, That the Iowa General Assembly urges the Attorney
  1 35 General of the State of Iowa to enforce the provisions of Code
  2  1 section 9H.2 against processors who use any direct or indirect
  2  2 scheme in order to own, operate, or control a feedlot in Iowa
  2  3 in which hogs or cattle are fed for slaughter, including the
  2  4 vigorous enforcement of provisions prohibiting processors from
  2  5 providing financing to persons who own or operate such
  2  6 feedlots or controlling such feedlots by use of production
  2  7 contracts.
  2  8    BE IT FURTHER RESOLVED, That, upon passage, a copy of this
  2  9 Resolution be sent by the Secretary of the Senate to the
  2 10 Attorney General of the State of Iowa.
