1 1 Section 1. Section 455B.204, subsection 1, Code 2001, is
1 2 amended by adding the following new paragraph after paragraph
1 3 a:
1 4 NEW PARAGRAPH. aa. "One-hundred-year floodplain" means
1 5 the land adjacent to a watercourse which may be inundated by a
1 6 flood, the magnitude of which has a one percent chance of
1 7 being equaled or exceeded in any year.
1 8 Sec. 2. Section 455B.204, subsection 2, Code 2001, is
1 9 amended by adding the following new paragraph after paragraph
1 10 b:
1 11 NEW PARAGRAPH. bb. An animal feeding operation structure
1 12 shall not be constructed on land which is located in a one-
1 13 hundred-year floodplain.
1 14 EXPLANATION
1 15 This bill amends Code section 455B.204, which provides
1 16 restrictions on where a confinement feeding operation may be
1 17 located in order to protect water quality. The bill provides
1 18 that a structure associated with a confinement feeding
1 19 operation cannot be located on land that is part of a 100-year
1 20 floodplain.
1 21 Generally, a person who violates a provision regulating
1 22 animal feeding operations is subject to a civil penalty. A
1 23 person violating a water quality provision is subject to a
1 24 civil penalty of up to $5,000.
