Senate Study Bill 1194

  1  1    Section 1.  Section 60.4, Code 2001, is amended to read as
  1  2 follows:
  1  3    60.4  STATEMENT.
  1  4    The contestant shall file the statement provided for in
  1  5 chapter 62 in the office of the secretary of state within ten
  1  6 two days from the day on which the returns are canvassed by
  1  7 the state board of canvassers, and, within the same time,
  1  8 serve a copy of the same, with a notice of the contest, on the
  1  9 incumbent in the manner provided by the rules of civil
  1 10 procedure for service of an original notice.
  1 11    Sec. 2.  Section 60.5, Code 2001, is amended to read as
  1 12 follows:
  1 13    60.5  ORGANIZATION AND TRIAL.
  1 14    The clerk of the court shall, immediately after the filing
  1 15 of the statement, notify the judges herein named, and fix a
  1 16 day for the organization of the court within three two days
  1 17 thereafter, and also notify the parties to the contest.  The
  1 18 judges shall meet on the day fixed, and organize the court,
  1 19 and make and announce such rules for the trial of the case as
  1 20 they shall think necessary for the protection of the rights of
  1 21 each party and a just and speedy trial of the case, and
  1 22 commence the trial of the case as early as practicable
  1 23 thereafter, and so arrange for and conduct the trial that a
  1 24 final determination of the same and judgment shall be rendered
  1 25 at least six days before the first Monday after the second
  1 26 Wednesday in December next following.  
  1 27                           EXPLANATION
  1 28    This bill amends certain deadlines for contesting elections
  1 29 of presidential electors and congresspersons.  Current Code
  1 30 requires that the contest court render a judgment before
  1 31 notice of the contest is made and before the contest court is
  1 32 required to organize.  The bill shortens from 10 days after
  1 33 the state canvass to three days after the state canvass the
  1 34 time in which a contestant has to file a statement of contest
  1 35 and serve notice of the contest on the apparent winner.  The
  2  1 bill also shortens from three days to two days the time in
  2  2 which the clerk of court must fix a date for organization of
  2  3 the contest court.
