1 1 Section 1. NEW SECTION. 613.22 LIMITATION ON LIABILITY
1 2 – FIREARMS MANUFACTURERS.
1 3 A governmental entity shall not file a civil action or join
1 4 a civil action as a party to recover damages against a person
1 5 who manufactures firearms if the action is based on the lawful
1 6 design, manufacture, or sale of firearms. However, this
1 7 section does not prohibit a governmental entity from filing or
1 8 joining in a civil action resulting from a negligent design or
1 9 a manufacturing defect.
1 10 For purposes of this section, "governmental entity" means
1 11 this state, or any county, city, township, or political
1 12 subdivision of this state.
1 13 EXPLANATION
1 14 This bill creates a new Code section prohibiting
1 15 governmental entities from filing a civil action or joining a
1 16 civil action as a party to recover damages against a firearms
1 17 manufacturer based on the lawful design, manufacture, or sale
1 18 of firearms. The bill excludes civil actions based upon
1 19 negligent design or a manufacturing defect from the
1 20 prohibition. The bill defines "governmental entity" to mean
1 21 this state, or any county, city, township, or political
1 22 subdivision of this state.
