Senate Study Bill 1171

  1  1    Section 1.  Section 148A.2, Code 2001, is amended by adding
  1  2 the following new unnumbered paragraph:
  1  3    NEW UNNUMBERED PARAGRAPH.  A person or business entity,
  1  4 including the employees, agents, or representatives of the
  1  5 business entity, shall not use in connection with that
  1  6 person's name or the name or activity of the business entity,
  1  7 the words "physical therapy", "physical therapist",
  1  8 "physiotherapy", "licensed physical therapist",
  1  9 "physiotherapist", "registered physical therapist", "physical
  1 10 therapist assistant", "physiotherapist assistant", "licensed
  1 11 physical therapist assistant", "registered physical therapist
  1 12 assistant", or the letters "P.T.", "L.P.T.", "R.P.T.",
  1 13 "P.T.A.", "L.P.T.A.", "R.P.T.A.", or any other words,
  1 14 abbreviations, or insignia indicating or implying directly or
  1 15 indirectly that physical therapy or physiotherapy is provided
  1 16 or supplied, including the billing of services labeled as
  1 17 physical therapy or physiotherapy, unless such services are
  1 18 provided by or under the direction of a physical therapist
  1 19 licensed pursuant to this chapter.  A person or entity that
  1 20 violates this paragraph is guilty of a serious misdemeanor,
  1 21 and a license to practice shall be revoked or suspended by the
  1 22 issuing board upon a finding by that board of fraud,
  1 23 misrepresentation, or use of untruthful or improbable
  1 24 statements in advertisements pursuant to section 147.55.
  1 25    Sec. 2.  Section 148A.3, subsection 1, Code 2001, is
  1 26 amended by striking the subsection and inserting in lieu
  1 27 thereof the following:
  1 28    1.  Persons licensed under any other chapter who are
  1 29 engaged in the practice of their profession if that person
  1 30 does not represent, imply, or claim that the person is a
  1 31 physical therapist, physiotherapist, physical therapist
  1 32 assistant, physiotherapist assistant, or a provider of
  1 33 physical therapy or physiotherapy.
  1 34    Sec. 3.  Section 148A.3, subsection 5, Code 2001, is
  1 35 amended by striking the subsection.  
  2  1                           EXPLANATION
  2  2    This bill provides title restrictions relating to the
  2  3 practice of physical therapy.  The bill provides that a person
  2  4 or business entity, including the employees, agents, or
  2  5 representatives of the business entity, shall not use in
  2  6 connection with their name or business activity a specified
  2  7 list of titles and abbreviations indicating that physical
  2  8 therapy or physiotherapy is provided or supplied, including
  2  9 the billing of services labeled as physical therapy or
  2 10 physiotherapy, unless such services are provided by or under
  2 11 the direction of a physical therapist licensed pursuant to
  2 12 Code chapter 148A.  The bill provides that a person or entity
  2 13 that violates this provision is guilty of a serious
  2 14 misdemeanor, and that a license to practice shall be revoked
  2 15 or suspended pursuant to Code section 147.55 for certain
  2 16 violations.
  2 17    The bill also provides that persons licensed under any
  2 18 other chapter who are engaged in the practice of their
  2 19 profession are not restricted by the provisions of Code
  2 20 chapter 148A if the person does not represent, imply, or claim
  2 21 that they are a physical therapist, physiotherapist, physical
  2 22 therapist assistant, physiotherapist assistant, or a provider
  2 23 of physical therapy or physiotherapy.  The bill additionally
  2 24 provides for the deletion of a provision which currently
  2 25 specifically exempts massage therapists, massage technicians,
  2 26 masseurs and masseuses who administer body massage by Swedish
  2 27 or other massage technique, including modalities, in a massage
  2 28 establishment, health club, athletic club, or school athletic
  2 29 department, from the requirements of Code chapter 148A,
  2 30 provided such individuals do not designate themselves to be
  2 31 physical therapists.
