Senate Study Bill 1137

  1  1    Section 1.  Section 50.48, subsection 4, unnumbered
  1  2 paragraph 1, Code 2001, is amended to read as follows:
  1  3    When all members of the recount board have been selected,
  1  4 the board shall undertake and complete the required recount as
  1  5 expeditiously as reasonably possible.  The commissioner or the
  1  6 commissioner's designee shall supervise the handling of
  1  7 ballots or voting machine documents to ensure that the ballots
  1  8 and other documents are protected from alteration or damage.
  1  9 The board shall open only the sealed ballot containers from
  1 10 the precincts specified to be recounted in the request or by
  1 11 the recount board.  The board shall recount only the ballots
  1 12 which were voted and counted for the office in question,
  1 13 including any disputed ballots returned as required in section
  1 14 50.5.  If an electronic tabulating system was used to count
  1 15 the ballots, the recount board may shall request the
  1 16 commissioner to retabulate the ballots using the electronic
  1 17 tabulating system.  The same program used for tabulating the
  1 18 votes on election day shall be used at the recount unless the
  1 19 program is believed or known to be flawed.  
  1 20                           EXPLANATION
  1 21    This bill provides that if an electronic tabulating system
  1 22 was used to count votes in an election, the recount of votes
  1 23 shall also be electronically tabulated unless the electronic
  1 24 tabulation system is believed or known to be flawed.
