  1  1    Section 1.  Section 320.5, Code 2001, is amended to read as
  1  2 follows:
  1  3    320.5  TERM OF GRANT.
  1  4    Such grants A grant made under section 320.4 shall be on
  1  5 such reasonable conditions as the state department of
  1  6 transportation or the board of supervisors may exact, and on
  1  7 such conditions as the general assembly may hereafter
  1  8 prescribe.  Grants for gas or water mains shall not exceed
  1  9 twenty years be extended in perpetuity, subject to changes for
  1 10 any future adjustments, improvements, relocations, or
  1 11 replacements of existing gas or water mains.  
  1 12                           EXPLANATION
  1 13    This bill amends Code section 320.5 to provide that a grant
  1 14 made by the state department of transportation or a county
  1 15 board of supervisors to allow the laying of gas mains in
  1 16 highways outside cities to local municipal distributing plants
  1 17 or companies and the laying of water mains in, under, or along
  1 18 highways, shall be extended in perpetuity, subject to changes
  1 19 for any future adjustments, improvements, relocations, or
  1 20 replacements of existing gas or water mains.  The bill also
  1 21 specifies that grants made by the state department of
  1 22 transportation under Code section 320.4 shall be on such
  1 23 reasonable conditions as the state department of
  1 24 transportation may exact.
