PAG LIN 1 1 Section 1. Section 15.104, subsection 5, unnumbered 1 2 paragraph 1, Code 2001, is amended to read as follows: 1 3 Review and approve or disapprove a life science enterprise 1 4 plan or amendments to that plan as provided in chapter 10C as 1 5 that chapter exists on or before June 30, 2004, and according 1 6 to rules adopted by the board. A life science plan shall make 1 7 a reasonable effort to provide for participation by persons 1 8 who are individuals or family farm entities actively engaged 1 9 in farming as defined in section 10.1. The persons may 1 10 participate in the life science enterprise by holding an 1 11 equity position in the life science enterprise or providing 1 12 goods or service to the enterprise under contract. The plan 1 13 must be filed with the board not later than June 30, 2004. 1 14 The life science enterprise may file an amendment to a plan at 1 15 any time. A life science enterprise is not eligible to file a 1 16 plan, unless the life science enterprise files a notice with 1 17 the board at least ninety days prior to filing the plan. The 1 18 notice shall be a simple statement indicating that the life 1 19 science enterprise may file a plan as provided in this 1 20 section.The notice must be filed with the board not later1 21than June 30, 2001.The notice, plan, or amendments shall be 1 22 submitted by a life science enterprise as provided by the 1 23 board. The board shall consult with the department of 1 24 agriculture and land stewardship during its review of a life 1 25 science plan or amendments to that plan. The plan shall 1 26 include information regarding the life science enterprise as 1 27 required by rules adopted by the board, including but not 1 28 limited to all of the following: 1 29 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 30 immediate importance, takes effect upon enactment. 1 31 EXPLANATION 1 32 During the 2000 legislative session, the general assembly 1 33 enacted H.F. 2491 creating new Code chapter 10C, providing for 1 34 the promotion of life science products. A life science 1 35 product is a product derived from an animal which includes 2 1 only embryos or oocytes for use in implantation; blood, milk, 2 2 or urine for use in the manufacture of pharmaceuticals or 2 3 nutriceuticals; or cells, tissue, or organs for use in 2 4 transplantation. 2 5 Code chapter 10C provides that a life science enterprise 2 6 may hold an interest in not more than 320 acres of 2 7 agricultural land for purposes of producing life science 2 8 products notwithstanding provisions in other Code chapters 2 9 such as Code chapters 9H and 567 which restrict who may hold 2 10 agricultural land for purposes of farming. Code section 2 11 15.104 requires that the economic development board approve a 2 12 plan for the acquisition of the land by a life science 2 13 enterprise. The plan must be filed with the board by June 30, 2 14 2004. The section provides that an enterprise is not eligible 2 15 to file a plan, unless it files a notice with the board by 2 16 June 30, 2001. 2 17 This bill eliminates the June 30, 2001, notice deadline and 2 18 provides that the enterprise must file its notice 90 days 2 19 before filing its plan. 2 20 The bill becomes effective upon enactment. 2 21 LSB 1163DP 79 2 22 da/cls/14
