  1  1    Section 1.  Section 137F.1, subsection 8, Code 2001, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  m.  The premises of a residence in which
  1  4 honey is stored; prepared; packaged, including by placement in
  1  5 a container; labeled; or from which honey is distributed.
  1  6    Sec. 2.  Section 137F.1, subsection 9, Code 2001, is
  1  7 amended to read as follows:
  1  8    9.  "Food processing plant" means a commercial operation
  1  9 that manufactures, packages, labels, or stores food for human
  1 10 consumption and does not provide food directly to a consumer.
  1 11 "Food processing plant" does not include premises any of the
  1 12 following:
  1 13    a.  A premises covered by a class "A" beer permit as
  1 14 provided in chapter 123.
  1 15    b.  A premises of a residence in which honey is stored;
  1 16 prepared; packaged, including by placement in a container;
  1 17 labeled; or from which honey is distributed.  
  1 18                           EXPLANATION
  1 19    Under Code section 137F.1, a "food establishment" is
  1 20 defined to mean an operation that stores, prepares, packages,
  1 21 or otherwise provides food for human consumption.   The same
  1 22 section defines "food processing plant" to mean a commercial
  1 23 operation that manufactures, packages, labels, or stores food
  1 24 for human consumption, if the operation does not provide food
  1 25 directly to a consumer.
  1 26    This bill amends the definitions of "food establishment"
  1 27 and "food processing plant" to provide that they do not
  1 28 include the premises of a residence in which honey is stored;
  1 29 prepared; packaged, including by placement in a container;
  1 30 labeled; or from which honey is distributed.
