PAG LIN 1 1 Section 1. Section 331.605, subsection 2, paragraph a, 1 2 Code 2001, is amended to read as follows: 1 3 a. The feesspecified in section 483A.1established by the 1 4 natural resource commission pursuant to section 455A.5. 1 5 Sec. 2. Section 331.605, subsection 3, Code 2001, is 1 6 amended to read as follows: 1 7 3. A state migratory game bird fee asprovided in section1 8483A.1established by the natural resource commission pursuant 1 9 to section 455A.5. 1 10 Sec. 3. Section 455A.5, subsection 6, Code 2001, is 1 11 amended by adding the following new paragraph: 1 12 NEW PARAGRAPH. g. Establish, by rule, the fees for all 1 13 hunting, fishing, fur harvesting, and trout fishing licenses; 1 14 for licenses for fishers of commercial species, for commercial 1 15 gear tags, and for bait dealers, aquaculture units, fur 1 16 dealers, taxidermy, game breeders, and falconry licenses; and 1 17 for nongame support, wildlife habitat, fish habitat, and 1 18 migratory game bird programs; and for related licenses under 1 19 the jurisdiction of the commission for the seasons beginning 1 20 on or after January 1, 2003. The commission shall not 1 21 increase any fee provided for in this paragraph more often 1 22 than once during a two-year period and a fee increase shall 1 23 not exceed the percentage increase in the consumer price index 1 24 published in the federal register by the United States 1 25 department of labor for the fiscal period since the last 1 26 increase for that fee. Each fee increase shall be rounded to 1 27 the nearest fifty cents. 1 28 Sec. 4. Section 481A.38, subsection 2, Code 2001, is 1 29 amended to read as follows: 1 30 2. If the commission finds that the number of hunters 1 31 licensed or the type of license issued to take deer or wild 1 32 turkey should be limited or further regulated the commission 1 33 shall conduct a drawing to determine which applicants shall 1 34 receive a license and the type of license. Applications for 1 35 licenses shall be received during a period established by the 2 1 commission. At the end of the period a drawing shall be 2 2 conducted. The commission may establish rules to issue 2 3 licenses after the established application period. If an 2 4 applicant receives a deer license which is more restrictive 2 5 than licenses issued to others for the same period and place, 2 6 the applicant shall receive a certificate with the license 2 7 entitling the applicant to priority in the drawing for the 2 8 less restrictive deer licenses the following year. The 2 9 certificate must accompany that person's application the 2 10 following year, or the applicant will not receive this 2 11 priority. Persons purchasing a deer license for the gun 2 12 season under this section and under section483A.1455A.5 are 2 13 not eligible for a gun deer hunting license under section 2 14 483A.24, except as authorized by rules of the department. 2 15 This subsection does not apply to the hunting of wild turkey 2 16 on a hunting preserve licensed under chapter 484B. 2 17 Sec. 5. Section 482.4, subsections 6 and 7, Code 2001, are 2 18 amended by striking the subsections. 2 19 Sec. 6. Section 483A.1, unnumbered paragraph 1, Code 2001, 2 20 is amended by striking the unnumbered paragraph and inserting 2 21 in lieu thereof the following: 2 22 Except as otherwise provided in this chapter, a person 2 23 shall not fish, trap, hunt, pursue, catch, kill, take, use, 2 24 possess, sell, or transport all or part of a wild animal, 2 25 bird, game, or fish, the protection and regulation of which is 2 26 desirable for the conservation of resources of this state, 2 27 without first obtaining a license for that purpose and paying 2 28 a fee established by rule of the commission. 2 29 Sec. 7. Sections 483A.1, subsections 1, 2, and 3, Code 4 32 2001, as amended by section 7 of this Act, are amended by 4 33 striking the subsections. 4 34 Sec. 9. Section 483A.1A, subsection 4, paragraph b, Code 4 35 2001, is amended to read as follows: 5 1 b. Is a full-time student at an educational institution 5 2 located in this state and resides in this state while 5 3 attending the educational institution. A student qualifies as 5 4 a resident pursuant to this paragraph only for the purpose of 5 5 purchasing any resident license specified in section483A.15 6 455A.5 or 484A.2. 5 7 Sec. 10. NEW SECTION. 483A.3A FISH HABITAT FEE. 5 8 A resident or nonresident required to have a fishing 5 9 license shall not fish unless the person has paid the fish 5 10 habitat fee or trout fishing fee. Fish habitat fees shall be 5 11 administered in the same manner as fishing licenses except 5 12 that all revenue derived from fish habitat fees shall be 5 13 deposited in the state fish and game protection fund and shall 5 14 be used within this state for fish habitat development. This 5 15 section shall not apply to residents who are younger than 5 16 sixteen years of age or are sixty-five years of age or more, 5 17 or to residents or nonresidents when fishing in privately 5 18 owned farm ponds or lakes. 5 19 Sec. 11. Section 438A.8, subsection 4, Code 2001, is 5 20 amended to read as follows: 5 21 4. The commission may provide, by rule, for the issuance 5 22 of an additional antlerless deer license to a person who has 5 23 been issued an antlerless deer license. The rules shall 5 24 specify the number of additional antlerless deer licenses 5 25 which may be issued, and the season and zone in which the 5 26 license is valid.The fee for an additional antlerless deer5 27license shall be ten dollars for residents.5 28 Sec. 12. EFFECTIVE AND APPLICABILITY DATES. 5 29 1. Sections 1, 2, 3, 4, 6, and 9 of this Act take effect 5 30 January 1, 2003. 5 31 2. Sections 7, 10 and 11 of this Act take effect December 5 32 15, 2001, and apply to licenses, permits, and fees for 5 33 wildlife and game activities for the years beginning on or 5 34 after January 1, 2002. 5 35 3. Sections 5 and 8 of this Act take effect January 1, 6 1 2003. It is the intent of the general assembly that 6 2 intervening amendments to the Code provisions stricken in 6 3 sections 5 and 8 of this Act are also to be stricken effective 6 4 January 1, 2003. 6 5 EXPLANATION 6 6 This bill amends sections of the Code relating to the 6 7 regulation of fish and game. 6 8 The bill also increases the fees for hunting, fishing, and 6 9 fur harvesting, except lifetime licenses for residents, by 6 10 amounts ranging from $.50 to $25.50. Two new fees of $38.00 6 11 for a deer and turkey combination bow and arrow license and of 6 12 $3.00 for fish habitat are added. Also, an antlerless only 6 13 deer license is added with a fee of $16.00 and the resident 6 14 and nonresident seven-day fishing licenses are separated and 6 15 the fee is increased to $12.00 for a resident license and to 6 16 $27.00 for a nonresident license. The fee of $10.00 for an 6 17 additional antlerless deer hunting license is stricken. 6 18 Effective January 1, 2003, the natural resource commission is 6 19 authorized to establish, by rule, the license and permit fees. 6 20 The commission shall not increase any fee more often than once 6 21 during a two-year period and the increase shall not exceed the 6 22 percentage increase in the consumer price index published in 6 23 the federal register since the last increase for that fee. 6 24 Each fee increase shall be rounded to the nearest $.50. 6 25 The payment of a fish habitat fee of $3.00 or a trout 6 26 fishing fee is required of resident and nonresident fishers in 6 27 addition to their fishing license fee. The fish habitat fee 6 28 is not required of residents who are less than 16 years of age 6 29 or are 65 years of age or older, or to residents or 6 30 nonresidents when fishing in privately owned farm ponds or 6 31 lakes. The revenue shall be credited to the state fish and 6 32 game protection fund and used within the state for fish 6 33 habitat development. 6 34 The bill includes a delayed effective date of January 1, 6 35 2003, for those provisions authorizing the natural resource 7 1 commission to set license and permit fees. The fee schedule 7 2 in Code section 483A.1 takes effect December 15, 2001, for 7 3 licenses, permits, and fees for wildlife and game activities 7 4 for the years beginning on or after January 1, 2002. The fee 7 5 schedules in Code sections 482.4 and 483A.1 are repealed 7 6 effective January 1, 2003.
