  1  1    Section 1.  Section 135G.7, unnumbered paragraph 1, Code
  1  2 2001, is amended to read as follows:
  1  3    The department shall adopt rules pursuant to chapter 17A to
  1  4 administer this chapter.  The rules shall be subject to
  1  5 approval by the board of health prior to adoption by the
  1  6 department of inspections and appeals.  The department shall
  1  7 adopt and enforce rules setting minimum standards for birth
  1  8 centers.  However, the standards shall parallel and shall not
  1  9 exceed standards adopted by the maternity center association,
  1 10 and state and local building codes where applicable, including
  1 11 the following:
  1 12    Sec. 2.  Section 135G.7, subsection 3, Code 2001, is
  1 13 amended by striking the subsection.
  1 14    Sec. 3.  Section 135G.8, subsection 1, paragraph b, Code
  1 15 2001, is amended to read as follows:
  1 16    b.  The criteria for the selection of clients and the es-
  1 17 tablishment of risk status shall be defined by departmental
  1 18 rule, which shall reflect risk status standards adopted by the
  1 19 maternity center association.
  1 20    Sec. 4.  Section 135G.12, subsection 2, Code 2001, is
  1 21 amended to read as follows:
  1 22    2.  Consultation may be provided on-site or by telecom-
  1 23 munication telemedicine as required by clinical and geographic
  1 24 conditions.  For the purpose of this subsection,
  1 25 "telemedicine" means telemedicine as defined by rule of the
  1 26 Iowa telecommunications and technology commission.  
  1 27                           EXPLANATION
  1 28    This bill makes changes in Code chapter 135G relating to
  1 29 birth centers.  The bill changes references to standards to be
  1 30 used by birth centers by eliminating references to the
  1 31 standards used by the maternity center association, and
  1 32 instead referring to the standards adopted by rule of the
  1 33 department of inspections and appeals.  The bill also changes
  1 34 a reference to "telecommunication" to "telemedicine" relating
  1 35 to the means by which consultation services may be provided to
  2  1 a birthing center.
