  1  3                       A JOINT RESOLUTION
  1  4 AUTHORIZING THE SIXTH JUDICIAL DISTRICT DEPARTMENT OF
  1  5    CORRECTIONAL SERVICES TO EXTEND OR ENTER INTO A NEW
  1  6    LEASE-PURCHASE AGREEMENT AND PROVIDING AN EFFECTIVE DATE.

  1  8    WHEREAS, the sixth judicial district department of
  1  9 correctional services entered into a lease-purchase agreement
  1 10 with Merchants National Bank of Cedar Rapids on April 1, 1991,
  1 11 for real property located in Johnson and Linn counties where
  1 12 the current community-based correctional facilities are now
  1 13 located; and
  1 14    WHEREAS, the lease-purchase agreement was assigned to
  1 15 Firstar Bank of Milwaukee; and
  1 16    WHEREAS, the sixth judicial district department of
  1 17 correctional services is desirous to exercise an option in the
  1 18 lease-purchase agreement to acquire approximately ten acres of
  1 19 real property located next to the community-based correctional
  1 20 facility in Cedar Rapids, Iowa, or is desirous to enter into a
  1 21 new lease-purchase agreement to refund the current lease-
  1 22 purchase agreement and to acquire such property; and
  1 23    WHEREAS, the current lease-purchase agreement is for a term
  1 24 commencing on April 25, 1991, and ending on June 1, 2006; and
  1 25    WHEREAS, if a new lease-purchase agreement is entered into,
  1 26 the term would commence in the year 2001, and end on June 1,
  1 27 2008; and
  1 28    WHEREAS, the sixth judicial district department of
  1 29 correctional services requests authorization from the general
  1 30 assembly pursuant to Code section 905.4, subsection 5, for an
  1 31 extension of the lease-purchase agreement with Firstar Bank of
  1 32 Milwaukee; and
  1 33    WHEREAS, the sixth judicial district department of
  1 34 correctional services requests authorization to enter into a
  1 35 new lease-purchase agreement in lieu of extending the current
  2  1 lease-purchase agreement if the district department so
  2  2 desires; and
  2  3    WHEREAS, the requested extension of the lease-purchase
  2  4 agreement is for a term commencing on June 1, 2006, and ending
  2  5 on June 1, 2008; and
  2  6    WHEREAS, current funding is adequate to meet the extension
  2  7 of or entering into a new lease-purchase obligation and no
  2  8 general fund moneys need to be appropriated to extend or enter
  2  9 into a new lease-purchase agreement; NOW THEREFORE,
  2 10  
  2 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  2 13    Section 1.  AUTHORIZATION BY GENERAL ASSEMBLY.  The general
  2 14 assembly pursuant to Code section 905.4, subsection 5,
  2 15 authorizes the sixth judicial district department of
  2 16 correctional services to extend for a period of two years,
  2 17 from June 1, 2006, through June 1, 2008, the lease-purchase
  2 18 agreement entered into with Merchants National Bank of Cedar
  2 19 Rapids on April 1, 1991, and assigned to Firstar Bank of
  2 20 Milwaukee for the acquisition of approximately ten acres of
  2 21 real property located next to the community-based correctional
  2 22 facility in Cedar Rapids, Iowa.  The general assembly also
  2 23 authorizes the sixth judicial district department of
  2 24 correctional services, in lieu of extending the current lease-
  2 25 purchase agreement, to enter into a new lease-purchase
  2 26 agreement for a period beginning in the year 2001 and
  2 27 extending through June 1, 2008, for the purpose of refunding
  2 28 the current lease-purchase agreement and financing the
  2 29 acquisition of approximately ten acres of real property
  2 30 located next to the community-based correctional facility in
  2 31 Cedar Rapids, Iowa.  The general assembly acknowledges that
  2 32 the sixth judicial district department of correctional
  2 33 services has adequate funding to meet the extension or
  2 34 entering into of a new lease-purchase agreement and that no
  2 35 state general fund appropriations need to be made to extend or
  3  1 enter into a new lease-purchase agreement.
  3  2    Sec. 2.  EFFECTIVE DATE.  This joint resolution, being
  3  3 deemed of immediate importance, takes effect upon enactment.
