  1  1    Section 1.  Section 904.508A, Code 2001, is amended to read
  1  2 as follows:
  1  3    904.508A  INMATE TELEPHONE REBATE FUND.
  1  4    The It is the policy of the department to encourage and
  1  5 facilitate family relationships between an inmate and the
  1  6 inmate's family.  In order to encourage the inmate's family
  1  7 relationships, the department shall operate a telephone system
  1  8 that generates no more revenue for the department than it
  1  9 costs to operate the system.  If the department collects more
  1 10 in revenue from inmates' use of the system than it costs to
  1 11 operate the system, the department is authorized to establish
  1 12 and maintain an inmate telephone rebate fund in each
  1 13 institution for the deposit of moneys received for inmate
  1 14 telephone rebates in excess of the costs to operate the
  1 15 system.  All funds deposited in this fund shall be used for
  1 16 the benefit of inmates.  The director shall adopt rules
  1 17 providing for the disbursement of moneys from the fund.  For
  1 18 purposes of this section, "benefit of inmates" means to
  1 19 financially assist an inmate who is granted an emergency
  1 20 furlough to visit a family member who is terminally ill or to
  1 21 attend a family member's funeral.  
  1 22                           EXPLANATION
  1 23    This bill relates to the inmate telephone rebate fund
  1 24 established in the department of corrections.
  1 25    The bill encourages the department of corrections to foster
  1 26 an inmate's family relationships.  The bill provides that in
  1 27 order to facilitate an inmate's family relationships, the
  1 28 department of corrections shall operate a telephone system
  1 29 that generates no more revenue for the department than it
  1 30 costs to operate the system.  The bill provides that if the
  1 31 department collects more in revenue from inmates' use of the
  1 32 system than it costs to operate the system, the excess moneys
  1 33 received by the department shall be deposited in the inmate
  1 34 telephone rebate fund.  The bill and current law provide that
  1 35 moneys in the fund shall be used for the benefit of inmates.
  2  1 The bill defines "benefit of inmates" to mean to provide
  2  2 financial assistance to inmates on emergency furlough to visit
  2  3 a terminally ill family member or attend the funeral of a
  2  4 family member.
