1 4 PROVIDING FOR ACCESS TO THE IOWA COMMUNICATIONS NETWORK BY
1 5 HOMELAND SECURITY OR DEFENSE FACILITIES.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 8D.2, subsection 5, Code Supplement
1 10 2001, is amended to read as follows:
1 11 5. a. "Public agency" means a state agency, an
1 12 institution under the control of the board of regents, the
1 13 judicial branch as provided in section 8D.13, subsection 17, a
1 14 school corporation, a city library, a library service area as
1 15 provided in chapter 256, a county library as provided in
1 16 chapter 336, or a judicial district department of correctional
1 17 services established in section 905.2, to the extent provided
1 18 in section 8D.13, subsection 15, an agency of the federal
1 19 government, or a United States post office which receives a
1 20 federal grant for pilot and demonstration projects.
1 21 b. For the purposes of this chapter, "public agency" also
1 22 includes any homeland security or defense facility established
1 23 by the administrator of the emergency management division of
1 24 the department of public defense or the governor or any
1 25 facility connected with a security or defense system as
1 26 required by the administrator of the emergency management
1 27 division of the department of public defense or the governor.
1 28 A facility that is considered a public agency pursuant to this
1 29 paragraph shall be authorized to access the Iowa
1 30 communications network strictly for homeland security
1 31 communication purposes. Any utilization of the network that
1 32 is not related to communications concerning homeland security
1 33 is expressly prohibited.
