1 4 PROHIBITING A REGISTERED SEX OFFENDER FROM RESIDING NEAR A
1 5 SCHOOL OR CHILD CARE FACILITY, AND PROVIDING A PENALTY.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 692A.1, Code Supplement 2001, is
1 10 amended by adding the following new subsection:
1 11 NEW SUBSECTION. 1A. "Child care facility" means as
1 12 defined in section 237A.1.
1 13 Sec. 2. Section 692A.5, subsection 1, Code 2001, is
1 14 amended by adding the following new paragraph:
1 15 NEW PARAGRAPH. g. Inform the person, if the person's
1 16 residency is restricted under section 692A.2A, that the person
1 17 shall not reside within two thousand feet of the real property
1 18 comprising a public or nonpublic elementary or secondary
1 19 school, or a child care facility.
1 20 Sec. 3. NEW SECTION. 692A.2A RESIDENCY RESTRICTIONS –
1 21 CHILD CARE FACILITIES AND SCHOOLS.
1 22 1. For purposes of this section, "person" means a person
1 23 who has committed a criminal offense against a minor, or an
1 24 aggravated offense, sexually violent offense, or other
1 25 relevant offense that involved a minor.
1 26 2. A person shall not reside within two thousand feet of
1 27 the real property comprising a public or nonpublic elementary
1 28 or secondary school or a child care facility.
1 29 3. A person who resides within two thousand feet of the
1 30 real property comprising a public or nonpublic elementary or
1 31 secondary school, or a child care facility, commits an
1 32 aggravated misdemeanor.
1 33 4. A person residing within two thousand feet of the real
1 34 property comprising a public or nonpublic elementary or
1 35 secondary school or a child care facility does not commit a
2 1 violation of this section if any of the following apply:
2 2 a. The person is required to serve a sentence at a jail,
2 3 prison, juvenile facility, or other correctional institution
2 4 or facility.
2 5 b. The person is subject to an order of commitment under
2 6 chapter 229A.
2 7 c. The person has established a residence prior to the
2 8 effective date of this Act or a school or child care facility
2 9 is newly located on or after the effective date of this Act.
2 10 d. The person is a minor or a ward under a guardianship.
