1 1 Section 1. Section 481A.48, subsection 1, Code Supplement
1 2 2001, is amended to read as follows:
1 3 1. No person, except as otherwise provided by law, shall
1 4 willfully disturb, pursue, shoot, kill, take or attempt to
1 5 take or have in possession any of the following game birds or
1 6 animals except within the open season established by the
1 7 commission: Gray or fox squirrel, bobwhite quail, cottontail
1 8 or jack rabbit, duck, snipe, pheasant, goose, woodcock,
1 9 partridge, coot, rail, ruffed grouse, wild turkey, pigeons, or
1 10 deer. The seasons, bag limits, possession limits and locality
1 11 shall be established by the department or commission under the
1 12 authority of sections 456A.24, 481A.38, and 481A.39. In
1 13 establishing limits on deer hunting during the late
1 14 muzzleloader season, the commission or the department shall
1 15 permit hunting in a party and shall not require a licensee to
1 16 shoot and tag a deer only by using the license and tag issued
1 17 in the licensee's name.
1 18 EXPLANATION
1 19 This bill requires that the natural resource commission or
1 20 the department of natural resources permit hunting in a party
1 21 during the late muzzleloader season and shall not require a
1 22 licensee to shoot and tag a deer only by using the license and
1 23 tag issued in the licensee's name. Under Iowa administrative
1 24 code 571-106.4(2), during muzzleloader seasons, a person may
1 25 shoot and tag a deer only by using the license and tag issued
1 26 in the person's name.
