  1  1    Section 1.  Section 301.1, Code 2001, is amended to read as
  1  2 follows:
  1  3    301.1  ADOPTION – PURCHASE AND SALE – ACCREDITED
  1  4 NONPUBLIC SCHOOL PUPIL TEXTBOOK SERVICES.
  1  5    1.  The board of directors of each and every school
  1  6 district is hereby authorized and empowered to adopt textbooks
  1  7 for the teaching of all branches that are now or may hereafter
  1  8 be authorized to be taught in the public schools of the state,
  1  9 and to contract for and buy said books and any and all other
  1 10 necessary school supplies at said contract prices, and to sell
  1 11 the same to the pupils of their respective districts at cost,
  1 12 loan such textbooks to such pupils free, or rent them to such
  1 13 pupils at such reasonable fee as the board shall fix, and said
  1 14 money so received shall be returned to the general fund.
  1 15    2.  Textbooks adopted and purchased by a school district
  1 16 may, and shall, to the extent funds are appropriated by the
  1 17 general assembly, be made available to pupils attending
  1 18 accredited nonpublic schools upon request of the pupil or the
  1 19 pupil's parent under comparable terms as made available to
  1 20 pupils attending public schools.  If the general assembly
  1 21 appropriates moneys for purposes of making textbooks available
  1 22 to accredited nonpublic school pupils, the department of
  1 23 education shall ascertain the amount available to a school
  1 24 district for the purchase of nonsectarian, nonreligious
  1 25 textbooks for pupils attending accredited nonpublic schools.
  1 26 The amount shall be in the proportion that the basic
  1 27 enrollment of a participating accredited nonpublic school
  1 28 bears to the sum of the basic enrollments of all participating
  1 29 accredited nonpublic schools in the state for the budget year.
  1 30 For purposes of this section, a "participating accredited
  1 31 nonpublic school" means an accredited nonpublic school that
  1 32 certifies its actual enrollment to the department of education
  1 33 by October 1, annually.  By October 15, annually, the
  1 34 department of education shall certify to the director of
  1 35 revenue and finance the annual amount to be paid to each
  2  1 school district, and the director of revenue and finance shall
  2  2 draw warrants payable to school districts in accordance with
  2  3 this subsection.  For purposes of this subsection, an
  2  4 accredited nonpublic school's enrollment count shall include
  2  5 only students who are residents of Iowa.  The costs of
  2  6 providing textbooks to accredited nonpublic school pupils as
  2  7 provided in this subsection shall not be included in the
  2  8 computation of district cost under chapter 257, but shall be
  2  9 shown in the budget as an expense from miscellaneous income.
  2 10 Textbook expenditures made in accordance with this subsection
  2 11 shall be kept on file in the school district.
  2 12    3.  As used in this paragraph subsection 2, "textbooks"
  2 13 means books and loose-leaf or bound manuals, systems of
  2 14 reusable instructional materials or combinations of books and
  2 15 supplementary instructional materials which convey information
  2 16 to the student or otherwise contribute to the learning
  2 17 process, or electronic textbooks, including but not limited to
  2 18 computer software, applications using computer-assisted
  2 19 instruction, interactive videodisc, and other computer
  2 20 courseware and magnetic media.
  2 21    Sec. 2.  Sections 301.29 and 301.30, Code 2001, are
  2 22 repealed.  
  2 23                           EXPLANATION
  2 24    This bill provides that when the general assembly
  2 25 appropriates funds for textbooks for accredited nonpublic
  2 26 school pupils, the department of education must determine the
  2 27 amount available to a school district for the purchase of the
  2 28 textbooks based upon the proportion that the basic enrollment
  2 29 of a participating accredited nonpublic school bears to the
  2 30 sum of the basic enrollments of all participating accredited
  2 31 nonpublic schools in the state for the budget year.
  2 32    The bill directs accredited nonpublic schools to certify
  2 33 their enrollments to the department by October 1 annually and
  2 34 directs the department to notify by October 15 annually each
  2 35 school district of the amount available for use to purchase
  3  1 nonsectarian, nonreligious textbooks for the participating
  3  2 accredited nonpublic schools.  The bill directs school
  3  3 districts to keep on file textbook expenditures made for
  3  4 accredited nonpublic schools.
  3  5    The bill repeals a provision that establishes a procedure
  3  6 by which the department pays claims submitted by school
  3  7 districts for the costs of providing textbook services.  The
  3  8 provision provides for the proration of the amounts paid to
  3  9 school districts if the general assembly does not provide
  3 10 sufficient funds.
