PAG LIN 1 1 Section 1. Section 6A.21, subsection 1, paragraph b, Code 1 2 2001, is amended to read as follows: 1 3 b. "Private development purposes" means the construction 1 4 of, or improvement related to,recreational trails,1 5 recreational development paid for primarily with private 1 6 funds, housing and residential development, or commercial or 1 7 industrial enterprise development. 1 8 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 9 immediate importance, takes effect upon enactment. 1 10 EXPLANATION 1 11 Current law provides that agricultural land may not be 1 12 condemned for private development purposes unless the owner of 1 13 the land consents to the condemnation. This bill removes 1 14 recreational trails from the definition of "private 1 15 development purposes". 1 16 The bill takes effect upon enactment. 1 17 LSB 5383XS 79 1 18 sc/sh/8
