1 1 Section 1. Section 142C.3, subsection 8, Code 2001, is
1 2 amended by striking the subsection and inserting in lieu
1 3 thereof the following:
1 4 8. A document of gift that is not revoked by the donor
1 5 prior to the donor's death does not require the consent or
1 6 concurrence of any other person after the donor's death and is
1 7 sufficient legal authority, following the donor's death, for
1 8 the removal of any part donated under the document of gift,
1 9 without the consent or concurrence of any other person. A
1 10 person, including but not limited to a family member, a
1 11 guardian, an attorney in fact named under a durable power of
1 12 attorney for health care, or an executor of the donor's
1 13 estate, is not authorized to and shall not revoke or in any
1 14 way supersede a document of gift that is not revoked by the
1 15 donor prior to the donor's death.
1 16 EXPLANATION
1 17 This bill provides that, under the uniform anatomical gift
1 18 Act, a document of gift that is not revoked by the donor prior
1 19 to the donor's death does not require the consent or
1 20 concurrence of any other person after the donor's death and is
1 21 sufficient legal authority, following the donor's death, for
1 22 the removal of any part donated under the document of gift,
1 23 without the consent or concurrence of any other person.
1 24 The bill also provides that a person, including but not
1 25 limited to a family member, a guardian, an attorney in fact
1 26 named under a durable power of attorney for health care, or an
1 27 executor of the donor's estate, is not authorized to and shall
1 28 not revoke or in any way supersede a document of gift that is
1 29 not revoked by the donor prior to the donor's death.
