1 1 Section 1. NEW SECTION. 600.7B PREFERENCE IN PLACEMENT
1 2 OF CHILD – FAMILY MEMBER.
1 3 Unless the juvenile court or court determines that such
1 4 placement is not in the best interests of the child, the
1 5 overriding criterion in the placement of a child for adoption
1 6 shall be placing the child with a relative of the child. For
1 7 the purposes of this section, "relative" means a stepparent or
1 8 a relative of the child within the fourth degree of
1 9 consanguinity.
1 10 EXPLANATION
1 11 This bill provides that, unless a court determines that
1 12 such a placement is not in the best interests of the child,
1 13 the overriding criterion in the placement of a child for
1 14 adoption shall be placing the child with a relative of the
1 15 child. For the purposes of the bill, "relative" means a
1 16 stepparent or a relative of the child within the fourth degree
1 17 of consanguinity. This definition of "relative" is the same
1 18 as that used for assumption of custody of a minor child by
1 19 acceptance of a release of custody under the termination of
1 20 parental rights chapter.
