  1  4 ELIMINATING THE REQUIREMENT THAT A BICYCLE SAFETY FLAG BE 
  1  5    USED WHILE OPERATING AN ALL-TERRAIN VEHICLE OR SNOWMOBILE 
  1  6    ON A HIGHWAY.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 321.234A, Code Supplement 2001, is
  1 11 amended by striking the section and inserting in lieu thereof
  1 12 the following:
  1 13    321.234A  ALL-TERRAIN VEHICLES – HIGHWAY USE.
  1 14    1.  All-terrain vehicles shall be operated on a highway
  1 15 only between sunrise and sunset and only when the operation on
  1 16 the highway is incidental to the vehicle's use for
  1 17 agricultural purposes.  A person operating an all-terrain
  1 18 vehicle on a highway shall have a valid driver's license and
  1 19 the vehicle shall be operated at speeds of thirty-five miles
  1 20 per hour or less.
  1 21    2.  A person convicted of a violation of this section is
  1 22 guilty of a simple misdemeanor punishable as a scheduled
  1 23 violation under section 805.8A, subsection 3, paragraph "f".
  1 24    Sec. 2.  Section 321G.13, subsection 9, Code Supplement
  1 25 2001, is amended by striking the subsection.
  1 26    Sec. 3.  Section 805.8B, subsection 2, paragraph b, Code
  1 27 Supplement 2001, is amended to read as follows:
  1 28    b.  For operating violations under section 321G.9,
  1 29 subsections 1, 2, 3, 4, 5, and 7, sections 321G.11, and
  1 30 321G.13, subsections 4 and 9 subsection 4, the scheduled fine
  1 31 is twenty dollars.
