1 1 Section 1. Section 692A.5, subsection 1, Code 2001, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. g. Inform the person that the person shall
1 4 not reside within one thousand feet of the real property
1 5 comprising a public or nonpublic elementary or secondary
1 6 school.
1 7 Sec. 2. NEW SECTION. 692A.2A RESIDENCY RESTRICTIONS –
1 8 SCHOOLS.
1 9 1. A person required to register under this chapter shall
1 10 not reside within one thousand feet of the real property
1 11 comprising a public or nonpublic elementary or secondary
1 12 school.
1 13 2. A person required to register under this chapter who
1 14 resides within one thousand feet of the real property
1 15 comprising a public or nonpublic elementary or secondary
1 16 school commits an aggravated misdemeanor.
1 17 3. A person does not commit a violation of this section if
1 18 the person is required to serve a sentence at a jail, prison,
1 19 juvenile facility, or other correctional institution or
1 20 facility which is within one thousand feet of the real
1 21 property comprising a school.
1 22 EXPLANATION
1 23 This bill prohibits a registered sex offender from residing
1 24 near a school.
1 25 The bill provides that a person required to register as a
1 26 sex offender shall not reside within 1,000 feet of the real
1 27 property comprising a public or nonpublic elementary or
1 28 secondary school. A person who violates the bill commits an
1 29 aggravated misdemeanor.
1 30 The bill also provides that prior to release or sentencing,
1 31 the person shall be informed about the restrictions on
1 32 residing near a school.
1 33 A sex offender does not violate the bill if the person is
1 34 required to serve a sentence at a jail, prison, juvenile
1 35 facility, or other correctional institution or facility which
2 1 is within 1,000 feet of the real property of a school.
2 2 An aggravated misdemeanor is punishable by confinement for
2 3 no more than two years and a fine of at least $500 but not
2 4 more than $5,000.
