  1  1    Section 1.  Section 56.6, subsection 1, paragraph c, Code
  1  2 2001, is amended by striking the paragraph and inserting in
  1  3 lieu thereof the following:
  1  4    c.  Reports shall be filed in a special election according
  1  5 to the following:
  1  6    (1)  A candidate's committee for a candidate for the
  1  7 general assembly shall file a report by the fourteenth day
  1  8 prior to the special election that is current through the
  1  9 nineteenth day prior to the special election.  The committee
  1 10 shall also file a supplemental report if it meets the criteria
  1 11 under subsection 1, paragraph "b".
  1 12    (2)  A candidate's committee for a candidate for county
  1 13 elective office shall file a report by the Friday immediately
  1 14 preceding the special election that is current through the
  1 15 Tuesday prior to the special election.  
  1 16                              EXPLANATION
  1 17    This bill amends Code section 56.6, pertaining to
  1 18 disclosure reports filed by candidates' committees.  The bill
  1 19 focuses on reports filed in special elections.
  1 20    The current paragraph "c" of subsection 1 of that Code
  1 21 section requires only that a general assembly candidate in a
  1 22 special election file a disclosure report 14 days prior to the
  1 23 election that is current through the nineteenth day prior to
  1 24 the election.  The bill retains that requirement, while also
  1 25 specifying that such a candidate must also file a supplemental
  1 26 report if the candidate receives $1,000 or more, including the
  1 27 fair market value of in-kind contributions, after filing the
  1 28 disclosure report.
  1 29    The bill also adds a requirement for a disclosure report in
  1 30 special elections for county offices.  These reports must be
  1 31 filed by the Friday before the special election, and the
  1 32 report must be current through the Tuesday prior to the
  1 33 special election.
  1 34    A person who violates either of these provisions is subject
  1 35 to the serious misdemeanor penalty provided in Code section
  2  1 56.16 for willful violation of any provision of the chapter.
  2  2 A serious misdemeanor is punishable by confinement for no more
  2  3 than one year and a fine of at least $250 but not more than
  2  4 $1,500.
