PAG LIN 1 1 Section 1. INTENT PURPOSE. It is the intent of the 1 2 general assembly to require the teaching of the nation's 1 3 founding and related documents, which shall include the 1 4 Declaration of Independence, the Constitution of the United 1 5 States, and the Federalist Papers; and to require each high 1 6 school student to successfully pass a test of knowledge of the 1 7 Declaration of Independence, the Constitution of the United 1 8 States, and the Federalist Papers prior to receiving a high 1 9 school diploma or a high school equivalency diploma. 1 10 Sec. 2. Section 256.11, subsection 5, paragraph b, 1 11 unnumbered paragraph 1, Code Supplement 2001, is amended to 1 12 read as follows: 1 13 Five units of the social studies including instruction in 1 14 voting statutes and procedures, voter registration 1 15 requirements, the use of paper ballots and voting machines in 1 16 the election process, and the method of acquiring and casting 1 17 an absentee ballot. All students shall complete a minimum of 1 18 one-half unit of United States government and one unit of 1 19 United States history. The one-half unit of United States 1 20 government shall include the voting procedure as described in 1 21 this lettered paragraph and section 280.9A. The government 1 22 instruction shall also include a study of the Constitution of 1 23 the United States and the Bill of Rights contained in the 1 24 Constitutionand, the Declaration of Independence, and the 1 25 Federalist Papers. Each student shall successfully pass an 1 26 assessment ofathe student's knowledge of the Constitution 1 27and, the Bill of Rights, the Declaration of Independence, and 1 28 the Federalist Papers prior to receiving a high school diploma 1 29 or a high school equivalency diploma. The unit of United 1 30 States history shall include the rights and responsibilities 1 31 of American citizenship and shall adequately stress the 1 32 contributions of all ethnic groups relating to the development 1 33 and growth of the United States into a great nation; to art, 1 34 music, education, medicine, literature, science, politics, and 1 35 government; and to employment in the service of the United 2 1 States during the nation's wars. 2 2 Sec. 3. STATE MANDATE FUNDING SPECIFIED. In accordance 2 3 with section 25B.2, subsection 3, the state cost of requiring 2 4 compliance with any state mandate included in this Act shall 2 5 be paid by a school district from state school foundation aid 2 6 received by the school district under section 257.16. This 2 7 specification of the payment of the state cost shall be deemed 2 8 to meet all the state funding-related requirements of section 2 9 25B.2, subsection 3, and no additional state funding shall be 2 10 necessary for the full implementation of this Act by and 2 11 enforcement of this Act against all affected school districts. 2 12 EXPLANATION 2 13 This bill states the intent of the general assembly to 2 14 require the teaching of the nation's founding and related 2 15 documents and to require each high school student to 2 16 successfully pass a test of knowledge of those documents prior 2 17 to receiving a high school diploma or a high school 2 18 equivalency diploma. The bill expands the educational 2 19 standards specified in the Code to accomplish this intent. 2 20 The bill expands the educational standards by amending the 2 21 Code provision that requires public schools and accredited 2 22 nonpublic schools to provide one-half unit of United States 2 23 government and one unit of United States history, to require 2 24 that the half-unit of government instruction include, in 2 25 addition to study of the Constitution of the United States and 2 26 the Bill of Rights, study of the Declaration of Independence 2 27 and the Federalist Papers. The bill also requires that the 2 28 unit of United States history include the rights and 2 29 responsibilities of American citizenship, which must 2 30 adequately stress the contributions of all ethnic groups 2 31 relating to the growth, development, and wars of the United 2 32 States. 2 33 The bill may include a state mandate as defined in Code 2 34 section 25B.3. The bill requires that the state cost of any 2 35 state mandate included in the bill be paid by a school 3 1 district from state school foundation aid received by the 3 2 school district under Code section 257.16. The specification 3 3 is deemed to constitute state compliance with any state 3 4 mandate funding-related requirements of Code section 25B.2. 3 5 The inclusion of this specification is intended to reinstate 3 6 the requirement of political subdivisions to comply with any 3 7 state mandates included in the bill. 3 8 LSB 5248XS 79 3 9 kh/sh/8
