  1  4 RELATING TO AND MAKING TRANSPORTATION AND OTHER INFRASTRUCTURE-
  1  5    RELATED APPROPRIATIONS TO THE STATE DEPARTMENT OF 
  1  6    TRANSPORTATION AND THE DEPARTMENT OF GENERAL SERVICES, 
  1  7    INCLUDING ALLOCATION AND USE OF MONEYS FROM THE GENERAL FUND
  1  8    OF THE STATE, ROAD USE TAX FUND, AND PRIMARY ROAD FUND, 
  1  9    PROVIDING FOR THE NONREVERSION OF CERTAIN MONEYS, AND 
  1 10    DISCONTINUING DRIVER'S LICENSE RENEWAL BY MAIL.

  1 12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 13 
  1 14                           DIVISION I
  1 15               STATE DEPARTMENT OF TRANSPORTATION 
  1 16    Section 1.  There is appropriated from the general fund of
  1 17 the state to the state department of transportation for the
  1 18 fiscal year beginning July 1, 2001, and ending June 30, 2002,
  1 19 the following amounts, or so much thereof as is necessary, to
  1 20 be used for the purposes designated:
  1 21    1.  For airport engineering studies and improvement
  1 22 projects as provided in chapter 328:  
  1 23 .................................................. $  2,248,780
  1 24    2.  For the rail assistance program and to provide economic
  1 25 development project funding:  
  1 26 .................................................. $    600,000
  1 27    Sec. 2.  There is appropriated from the road use tax fund
  1 28 to the state department of transportation for the fiscal year
  1 29 beginning July 1, 2001, and ending June 30, 2002, the
  1 30 following amounts, or so much thereof as is necessary, for the
  1 31 purposes designated:
  1 32    1.  For the payment of costs associated with the production
  1 33 of driver's licenses, as defined in section 321.1, subsection
  1 34 20A:  
  1 35 .................................................. $  3,997,000
  2  1    Notwithstanding section 8.33, unencumbered or unobligated
  2  2 funds remaining on June 30, 2002, from the appropriation made
  2  3 in this subsection, shall not revert, but shall remain
  2  4 available for subsequent fiscal years for the purposes
  2  5 specified in this subsection.
  2  6    2.  For salaries, support, maintenance, and miscellaneous
  2  7 purposes:

  3 12    Sec. 3.  There is appropriated from the primary road fund
  3 13 to the state department of transportation for the fiscal year
  3 14 beginning July 1, 2001, and ending June 30, 2002, the
  3 15 following amounts, or so much thereof as is necessary, to be
  3 16 used for the purposes designated:
  3 17    1.  For salaries, support, maintenance, and miscellaneous
  3 18 purposes and for not more than the following full-time
  3 19 equivalent positions:
  3 20    a.  Operations and finance:

  4 13 expenses incurred in administering the merit system on behalf
  4 14 of the state department of transportation, as required by
  4 15 chapter 19A:

  5 23 office buildings and field garage facilities throughout the

  5 26    18.  For deferred maintenance projects at field facilities:

  5 28    19.  For completion of a site utilization study at the Ames
  5 29 complex:  
  5 30 .................................................. $    200,000
  5 31    Notwithstanding section 8.33, moneys appropriated in
  5 32 subsections 9 through 19 that remain unencumbered or
  5 33 unobligated at the close of the fiscal year shall not revert
  5 34 but shall remain available for expenditure for the purposes
  5 35 designated until the close of the fiscal year that begins July
  6  1 1, 2004.
  6  2    Sec. 4.  There is appropriated from the road use tax fund
  6  3 to the department of general services for the fiscal year
  6  4 beginning July 1, 2001, and ending June 30, 2002, the
  6  5 following amount, or so much thereof as is necessary, to be
  6  6 used for the purpose designated:
  6  7    For planning and design of a state institutional road that
  6  8 shall be an extension of Twelfth street south of Court avenue,
  6  9 adjacent to the new judicial building in Des Moines:  
  6 10 .................................................. $     34,000
  6 11    Notwithstanding section 8.33, moneys appropriated in this
  6 12 section that remain unencumbered or unobligated at the close
  6 13 of the fiscal year shall not revert but shall remain available
  6 14 for expenditure for the purpose designated until the close of
  6 15 the fiscal year that begins July 1, 2004.
  6 16    For purposes of this section, a "state institutional road"
  6 17 is part of the state park, state institution, and other state
  6 18 land road system, as defined in section 306.3.  
  6 19                           DIVISION II
  6 20                        STATUTORY CHANGES
  6 21    Sec. 5.  Section 312.2, subsection 18, Code 2001, is
  6 22 amended to read as follows:
  6 23    18.  The treasurer of state, before making the allotments
  6 24 provided for in this section, shall credit annually from the
  6 25 road use tax fund to the state department of transportation
  6 26 the sum of six hundred fifty thousand dollars for the purpose
  6 27 of providing county treasurers with data processing automation
  6 28 and telecommunications equipment and support for vehicle
  6 29 registration and titling and driver licensing.
  6 30 Notwithstanding section 8.33, unobligated funds credited under
  6 31 this subsection remaining on June 30 of the fiscal year shall
  6 32 not revert but shall remain available for expenditure for
  6 33 purposes of this subsection in subsequent fiscal years.
  6 34    Sec. 6.  Section 315.3, subsection 3, Code 2001, is amended
  6 35 to read as follows:
  7  1    3.  a.  If the state transportation commission receives and
  7  2 files a letter from the director of transportation certifying
  7  3 that federal funding is not forthcoming due to the failure of
  7  4 the United States Congress to pass and the president of the
  7  5 United States to approve legislation providing long-term
  7  6 federal transportation funding to the state of Iowa, the
  7  7 commission may authorize the temporary transfer of funds from
  7  8 the RISE fund to the primary road fund.  Transferred funds
  7  9 shall be repaid to the RISE fund within three months of
  7 10 transfer.
  7 11    b.  If the state transportation commission receives and
  7 12 files a letter from the director of transportation certifying
  7 13 that the cash flow funding of the department may be inadequate
  7 14 to meet anticipated road construction costs, the commission
  7 15 may authorize the temporary transfer of funds from the RISE
  7 16 fund to the primary road fund.  Funds transferred under this
  7 17 paragraph shall be repaid to the RISE fund within six months
  7 18 of transfer.
  7 19    c.  The commission shall manage the RISE fund to ensure
  7 20 that funds will be available to meet contract obligations on
  7 21 approved RISE projects.
  7 22    Sec. 7.  Section 321.189, subsection 4, Code 2001, is
  7 23 amended to read as follows:
  7 24    4.  SYMBOLS.  Upon the request of a licensee, or a person
  7 25 renewing the person's license by mail, the department shall
  7 26 indicate on the license, or the validation document issued to
  7 27 a person renewing by mail, the presence of a medical
  7 28 condition, that the licensee is a donor under the uniform
  7 29 anatomical gift law, or that the licensee has in effect a
  7 30 medical advance directive.  For purposes of this subsection, a
  7 31 medical advance directive includes, but is not limited to, a
  7 32 valid durable power of attorney for health care as defined in
  7 33 section 144B.1.  The license may contain such other
  7 34 information as the department may require by rule.
  7 35    Sec. 8.  Section 321.196, unnumbered paragraph 1, Code
  8  1 2001, is amended to read as follows:
  8  2    Except as otherwise provided, a driver's license, other
  8  3 than an instruction permit, chauffeur's instruction permit, or
  8  4 commercial driver's instruction permit issued under section
  8  5 321.180, expires, at the option of the applicant, two or four
  8  6 years from the licensee's birthday anniversary occurring in
  8  7 the year of issuance if the licensee is between the ages of
  8  8 seventeen years eleven months and seventy years on the date of
  8  9 issuance of the license.  If the licensee is under the age of
  8 10 seventeen years eleven months or age seventy or over, the
  8 11 license is effective for a period of two years from the
  8 12 licensee's birthday anniversary occurring in the year of
  8 13 issuance.  Except as required in section 321.188, and except
  8 14 for a motorcycle instruction permit issued in accordance with
  8 15 section 321.180 or 321.180B, a driver's license is renewable
  8 16 without written examination or penalty within a period of
  8 17 sixty days after its expiration date and without a driving
  8 18 test within a period of one year after its expiration date.  A
  8 19 person shall not be considered to be driving with an invalid
  8 20 license during a period of sixty days following the license
  8 21 expiration date.  However, for a license renewed within the
  8 22 sixty-day period, the date of issuance shall be considered to
  8 23 be the previous birthday anniversary on which it expired.
  8 24 Applicants whose licenses are restricted due to vision or
  8 25 other physical deficiencies may be required to renew their
  8 26 licenses every two years.  For the purposes of this section,
  8 27 the birthday anniversary of a person born on February 29 shall
  8 28 be deemed to occur on March 1.  The department in its
  8 29 discretion may authorize the renewal of a valid driver's
  8 30 license other than a commercial driver's license upon
  8 31 application without an examination provided that the applicant
  8 32 satisfactorily passes a vision test as prescribed by the
  8 33 department, or files a vision report in accordance with
  8 34 section 321.186A which shows that the applicant's visual
  8 35 acuity level meets or exceeds those required by the
  9  1 department, or is eligible for renewal by mail pursuant to
  9  2 rules adopted by the department.  The department may assess an
  9  3 applicant a fee of no more than two dollars for administration
  9  4 and mailing expenses for providing for renewal of the
  9  5 applicant's driver's license by mail.
