PAG LIN 1 1 Section 1. Section 321.180B, subsections 3 and 4, Code 1 2 2001, are amended to read as follows: 1 3 3. REMEDIAL DRIVER IMPROVEMENT ACTION OR SUSPENSION OF 1 4 PERMIT OR INTERMEDIATE LICENSE. A person who has been issued 1 5 an instruction permit or an intermediate license under this 1 6 section, upon conviction of a moving traffic violation or 1 7 involvement in a motor vehicle accident which occurred during 1 8 the term of the instruction permit or intermediate license, 1 9 shall be subject to remedial driver improvement action or 1 10 suspension of the permit or license. A person possessing an 1 11 instruction permit who has been convicted of a moving traffic 1 12 violation or has been involved in an accident shall not be 1 13 issued an intermediate license until the person has completed 1 14 the remedial driver improvement action and has been accident 1 15 and conviction free continuously for the six-month period 1 16 immediately preceding the application for the intermediate 1 17 license. A person possessing an intermediate license who has 1 18 been convicted of a moving traffic violation or has been 1 19 involved in an accident shall not be issued a full driver's 1 20 license until the person has completed the remedial driver 1 21 improvement action and has been accident and conviction free 1 22 continuously forthe twelve-month period immediately preceding1 23the application for a full driver's licensetwelve months. 1 24 4. FULL DRIVER'S LICENSE. A full driver's license may be 1 25 issued to a person seventeen years of age who possesses an 1 26 intermediate license issued under subsection 2 or a comparable 1 27 intermediate license issued by another state for a minimum of 1 28 twelve months immediately preceding application, and who 1 29 presents an affidavit signed by a parent or guardian on a form 1 30 to be provided by the department that the intermediate 1 31 licensee has accumulated a total of ten hours of street or 1 32 highway driving of which two hours were conducted after sunset 1 33 and before sunrise and the street or highway driving was with 1 34 the licensee's parent, guardian, instructor, a person 1 35 certified by the department, or a person at least twenty-five 2 1 years of age who had written permission from a parent or 2 2 guardian to accompany the licensee, whose driving privileges 2 3 have not been suspended, revoked, or barred under this chapter 2 4 or chapter 321J during the twelve-month period immediately 2 5 preceding the application for a full driver's license, and who 2 6 has been accident and conviction free continuously for, the2 7twelve-month period immediately preceding the application for2 8a full driver's licensetwelve months, and who has paid the 2 9 required fee. 2 10 EXPLANATION 2 11 This bill amends the graduated driver's license provisions 2 12 in Code section 321.180B to provide that a 17-year-old 2 13 intermediate driver's licensee who applies for a full driver's 2 14 license may still receive a full driver's license if the 2 15 person was accident and conviction free continuously for 12 2 16 months. Currently, such a licensee is required to be accident 2 17 and conviction free continuously for the 12-month period 2 18 immediately preceding the person's application for a full 2 19 driver's license. 2 20 LSB 2187SV 79 2 21 nh/cls/14
